Arrested for DUI – What Should I Do?
If you find yourself arrested for Driving Under the Influence of Alcohol (DUI) in the State of Arizona, and you have submitted to a breath, blood, or urine test, and the results of the test reveal a blood/breath alcohol result of .08% or higher, or you have refused these tests, you can expect to be involved in two separate legal proceedings.
- A criminal proceeding in court
- A civil proceeding with the Department of Motor Vehicles (MVD) and the likely suspension of your driver license.
These two proceedings are mutually exclusive; the outcome of one will not affect the other. You could win both matters or lose both matters. How the MVD driver license hearing is handled is extremely important.
Your DUI arrest begins your criminal proceeding. The consequences of this — plea of guilty, or a verdict of guilty following a jury or bench trial — could result in mandatory jail time, fines, fees and assessments, supervised or unsupervised probation, as well as a criminal record. The civil proceeding is conducted before an administrative hearing officer at the MVD. This proceeding deals with a possible suspension of your driver’s license, or if from out of state, your privilege to drive in Arizona. The arresting police officer will serve you with a “Notice of Suspension.” If you have been arrested in Arizona for DUI and you take a breath, blood or urine test, and the results measured a alcohol concentration of .08% or more within 2 hours of driving, or you refuse to take the blood, breath or other chemical test, the arresting police will serve you with a 90 day driver license suspension notice, or in the case of refusal, a 12 month driver license or driving privilege suspension. The police should give you two copies of this form.
If your test results indicate a result of .08% or higher, the police will seize your Arizona driver license, and issue you a temporary license which is valid for 15 days, or, if you request a hearing within the 15 day window, until the hearing is conducted and the outcome determined. Since the police confiscated your driver license, the yellow copy of the suspension notice is your temporary driver license.
If you are from out of state, the police cannot seize your driver license. They will serve you with a notice of suspension of your privilege to drive in Arizona. The suspension will take effect 15 days after service unless you request a hearing within the 15 days. If a hearing is requested, your privilege to drive in Arizona will not be suspended until the hearing is conducted and the outcome determined.
If you refused to take the breath, blood or urine test, the police will serve you a notice of a 12-month suspension of your driver license, or privilege to drive if you are from out of state. This suspension becomes effective 15 days from the date of service unless you request a hearing. If a hearing is requested your driver license or privilege to drive in Arizona will not be suspended until the hearing is conducted and the outcome determined. If your refused to take a breath, blood or urine test, it is likely that the police obtained a search warrant and obtained your blood anyway. If this is the case, your driver license or privilege to drive will still be suspended for 12 months even though the police obtained your blood through the use of a search warrant.
A request for hearing must be submitted in writing to the MVD. Generally, the pink copy of suspension form, furnished by the police, is used to request this hearing. It is important to fill out the information completely and accurately on the back of the pink form. You must check the box indicating you are requesting an Administrative Hearing and mail it, within 15 days of service to you by the police, to: Arizona Department of Transportation, Executive Hearing Office, Mail Drop 507M, P.O. Box 2100, Phoenix, AZ 85001-2100. Do not select Summary Review; this will not get you a hearing, but merely a review of the paperwork submitted by the police.
In the criminal case, if you plead guilty to the charge of DUI, or if you are found guilty, you will be sentenced in accordance within the present Arizona DUI sentencing guidelines. When the State receives notification of the verdict, your driver license will be suspended for 90 days. However, if you are a first offender, or you have had no DUI convictions within the past five years, and if you took the breath, blood or other required test, and if you have been found guilty in the criminal proceeding, or you feel that such a result is likely, then you may wish to agree to a suspension of your driver license prior to or at the MVD hearing.
Agreeing to the suspension will entitle you to a 60 day restricted driving permit following a 30 day suspension. The suspension is still classified as a 90 day suspension. To obtain the restricted driving permit, you must apply at a local MVD office following the first 30 days of the suspension. Agreeing to the suspension will generally resolve the civil proceeding sooner and oftentimes well before the resolution of your Criminal matter in court. This is advantageous as you get the suspension over with sooner and under less onerous circumstances. Agreeing to the suspension will generally result in no further suspension of your driver license if you later plead or are found guilty of your DUI in court. In the case of a stipulated suspension from MVD, there will be no requirement that you post proof of Financial Responsibility before your Arizona driver license or privilege is reinstated. Agreeing to the suspension will allow you to select the day you want your suspension to begin, so long as the suspension start date is within 45 days of your MVD hearing date. This allows flexibility in arranging transportation to work or school during the initial 30 days of the suspension. NOTE: If you request a hearing and actually go through with it and lose, the only difference is that your will not be able to choose the day the suspension begins. You should still be eligible for the 30 day driver license suspension followed by the 60 day restricted driving permit.
If you agree to the suspension, you do not get a hearing with the administrative law judge. You do not get to challenge the police officers or contest the evidence in the civil hearing. Sometimes this hearing may be important to gather critical evidence in your DUI case. However, this decision should not be made without first discussing your DUI case and individual circumstances with an experienced DUI defense attorney.
If you have the Administrative Hearing and win, and later lose your DUI case, either through a plea or finding of guilty at trial, MVD will suspend your driver license for 90 consecutive days. There is no eligibility for a restricted driving permit following the first 30 days of the suspension. Further, if you are convicted either through a plea or finding of guilty in court you will be required to provide proof of financial responsibility (insurance) for three years by filing with the State of Arizona either a $40,000 cash deposit, or Certificates of Deposit (CD’s) totaling $40,000 or a Certificate of Insurance (SR22). This Financial Responsibility requirement could have significant cost implications for you, depending upon your selection of acceptable Financial Responsibility filings and/or your insurance carrier’s underwriting requirements.

Celebrated annually across the globe on March 17, St Patrick’s Day is one of the world’s most popular celebrations. However, in more recent times, St Patrick’s Day has taken on an altogether more global and secular significance, with St Patrick’s Day celebrations being held around the world in various forms.
In the United States, people traditionally celebrate St Patrick’s Day by wearing green garments, drinking alcohol that’s been dyed green or indulging in other Irish themed activities. Many American cities put on St Patrick’s Day parades, including Cleveland, Boston and Kansas City; however the largest St Patrick’s Day Parade in the United States – and the world – is held in New York City and is said to be watched by over two million people.
The first St Patrick’s Day Parade in New York City was held in 1766, when Irish soldiers marched through the city, and in 2006, more than 150,000 people marched in the St Patrick’s Day Parade. Among those participating in the event were bands, members of the fire department, social and cultural clubs in the city, emigrant societies and military and police groups. Furthermore, prominent New York politicians, and those planning to run for office frequently appear in the St Patrick’s Day Parade.
Organised by the Ancient Order of Hibernians, the St Patrick’s Day Parade has attracted more than a little controversy in its time. For instance, the Ancient Order of Hibernians has often opted to appoint controversial Irish Republican figures as its Grand Marshall; what’s more, the group recently banned gay and lesbian groups from participating in the parade. As a result of this, alternative St Patrick’s Day parades, such as The Queens parade, have been organised by opposing groups; the Queens parade, for instance, is open to all groups who wish to march on St Patrick’s Day.
But whatever parade you choose to go and see, New York City is truly the place to be on St Patrick’s Day. With green bagels, green flowers, green hats and clothes a frequent sight on the day of the St Patrick’s Day Parade, New Yorkers tend to frequent local Irish pubs and drink Irish beers and liquors in celebration of the festival, which now takes on both religious and secular significance. And with plenty of affordable hotels in New York City to choose from, you won’t be stuck for accommodation in the city if you choose to visit on St Patrick’s Day. After all, how could you possibly resist the unique opportunity to eat a green New York bagel and drink a glass of dyed-green Guinness while basking in the emerald glow of the Empire State Building?

Mexican drug cartels, Hezbollah (Party of God) and other Islamic terrorist groups are joining forces in Mexico. Hezbollah is synonymous with terror, suicide bombings, kidnappings and beheadings. No wonder the criminal organizations in Mexico seem to have adopted many Middle Eastern terrorist tactics with kidnappings and beheadings happening throughout Mexico.
According to authorities global Islamic terrorist have moved into Mexico and other Latin American countries to open the door for Mexican cartels to have excess to Afghanistan cocaine at bargain basement prices, those profits from those sales are being passed on to Hezbollah and other terrorist organizations worldwide to attack the states from within. Hezbollah is known to be raising money for their cause in the U.S and some Americans say they have brought suite case dirty booms into the U.S. and are waiting for further instructions. Hezbollah is currently training Mexican drug cartel enforcement gang members. They are teaching them their gorilla terror tactic’s that they use in the Middle East. One high ranking Mexican Army officer who will at his request remain anonymous says Hezbollah is now believed to be training Mexican drug cartel enforcers the art of bomb making. It is now feared that there will soon be car and truck bombings of Mexican solders at the many road blocks that they have set up throughout Mexico, their barracks, police stations and even government buildings are at risk. The training is designed to combat the Mexican Army and police, American Special Forces and DEA agents now operating in Mexico.
According to Mexican officials Hezbollah is training the opposition to the Mexican Army and is starting to be seen throughout the country. There are new reports of late, of hit and run tactics against Mexican military set up road blocks where both attackers and Mexican solders have been killed.
Homeland Security has said that there are Hezbollah members operating in the U.S. and it is reasonable to believe they are in contact with other Hezbollah in Mexico and around the world. In addition to other terrorist attacks, Hezbollah has been tied to the 1983 Marine barracks bombing in Beirut that left 241 U.S. personnel dead, and the 1996 Khobar Towers attack in Saudi Arabia that left 19 U.S. servicemen dead.
One U.S. law enforcement official, speaking on condition of anonymity, says there is considerable forensic evidence tying Hezbollah bomb experts to roadside explosions in Iraq.
Dennis Lormel, who founded the counterterrorist financing program at the FBI, says the United States has been a cash cow for Hezbollah.
“They raise funds through business fronts, through criminal activity, use of shell companies and through fundraising mechanisms,” he says.
Before September 11, 2001, Hezbollah was responsible for more American deaths than any other terrorist organization. Hassan Nasrallah, the group’s secretary-general, recently proclaimed, “Death to America was, is, and will stay our slogan.”
In spite of all that, the terror and violence in Mexico, Mexican officials are encouraging Americans to visit Mexico in a new tourist campaign. But with more than 1,200 people having been killed this year alone in Ciudad Juárez that is not happening. Juarez has a population of 1.5 million people many depending on American tourist dollars. But many El Pasons who live in El Paso a bordering city of about 350,000 say they are just to frighten to risk going into Mexico.
Mexico’s violence of terror along with the world banking and financial crises that are happening today are forcing drastic changes in the rate of tourism to Mexico, especially border regions from the Gulf of Mexico to the Pacific Ocean. Mexico has been heavily dependent on tourism and American investors and both are drying up. Oil and drugs are now Mexico’s official and respectively unofficial main stay for what economy they have.
From Brownsville Texas to San Diego California the drug-related dangers and violence is so staggering that the country has been declared off-limits to all U.S. Military. Residents on the American side of the border have told the Laguna Journal that they are afraid to cross over to visit family, shop or conduct business anywhere along the border.
Violent spillover from crime-ridden Mexican border cities are a growing concern for Americans. With cartel-related killings in Chihuahua alone now topping over 1200 for the year, officials in the states are increasingly concerned about “spillover” of crime from neighboring border cites. In El Paso, real effects are being felt at the city’s hospital, where officials report dozens of cases of individuals wounded over the border in the Mexican state of Chihuahua being treated at their facility.
Just last week the State of Morelos Deputy A.G. for Organized Crime Affairs and two escorts were killed by what appeared to be a well organized paramilitary unit in a car-to-car gunfire assault. The killers then fled in two military style vehicles.
Another significant issue is that now Mexico’s toll of deaths linked to organized crime has reached four thousand so far this year, a historic record. That is more violent related deaths than Iraq and Afghanistan combined. Mexico is reported to be on track to near 5,000 before the end of 2008, another record. The last one thousand deaths have taken place in 48 days. The first one thousand deaths of the year took place in 114 days, the next one thousand in 72. But seventy days later, it reached 3 thousand.
Iran, Hezbollah’s longtime sponsor, and donations from the Lebanese Diaspora are two sources for a multimillion-dollar budget that pays for the militia’s armed and political wings and for social projects such as money, food and hospitals in Beirut. But investigations around the world have shown that Hezbollah also funds itself through drug dealing, arms trafficking, contraband smuggling and other rackets in the Americas, Africa Europe and elsewhere.
The L.A. Times is reporting U.S. and Colombian investigators have dismantled an international cocaine smuggling and money laundering ring in Bogota, Colombia and Madrid Spain, that allegedly used part of its profits to finance Hezbollah, the Lebanon-based Shiite militia, officials said.

A couple of armed men arrived at a funeral home in Juarez and opened fire on persons at a service for a man who himself had been the victim of a homicide. Three persons were wounded before the thugs left.

During the last 24 hours 38 persons have died in different events caused by members of organized crime; the number has reached 4,052 in 2008 in this country (Mexico), surpassing by more than three times the number of dead in Iraq this year, where they total 1,167.
Just recently, ten gunmen lost their lives after a shootout with state agents in Nogales, Sonora. The police were attacked with fragmentation grenades; three police and three civilians were wounded.
The body of a gagged man was found in Cabo San Lucas a known and popular American tourist spot. His fingers had been chopped off. Eight persons have died in Baja California Norte in the last 24 hours, the product of a spiral of violence. (Note: the Baja California Peninsula is divided into two states with the same name; each is differentiated by “Norte” and “Sur”) In the morning the bodies of two men were found, both shot to death out of different events.
Just recently two Rosarito police officers were assassinated while on patrol. Twenty kilometers away three other persons were murdered. This is an area where Americans murdered bodies have been found. A related account in “El Universal” (Mexico City) states that violence in Rosarito has cost the lives of seven police and at least a dozen other persons in less than thirty days; it adds that there have been mass resignations of police there because of fear of being murdered. (Note: just some years back Rosarito Beach was a laid back American tourist attraction, peaceful ocean beach town not far from Tijuana and San Diego.
According to Mexico City daily newspaper Reforma’s running tally of cartel-related killings, or Ejecuciones, (executions/assassinations) Chihuahua’s weekly rate of killings remained higher than it was before over two thousand soldiers and federal police were deployed there in mid-March. Seven other crimes took place in Chihuahua; two men were found dead in Hermosillo, Sonora, two in Culiacan and some others in Guanajuato, Guerrero, the Distrito Federal and Taxco.
From Aug. 9 to Aug. 15, Chihuahua had an unprecedented 79 ejecuciones, including the gangland-style killing of 13 partygoers in the town of Creel in the Sierra Tarahumara Mountains, a key transit point for drugs en route to the U.S.-Mexico border. Among the dead were several teenagers, a university professor, and a 1-year-old baby.
The previous week, eight were shot and killed during a prayer session at a drug and alcohol rehabilitation center in Cuidad Juárez. These attacks challenge a common perception that Mexico’s escalating death toll is reducible to cartel members killing other cartel members, and have driven local and state officials to publicly question the efficacy of the current campaign against the cartels. In a televised address, Chihuahua Gov. José Reyes Baeza Terrazas said that the massacre in Creel among other similar, recent events throughout the state show that “the strategy and actions for guaranteeing the security of people in [Chihuahua] need to be radically modified.”
Research group Consulta Mitofsky’s annual survey Encuesta Nacional en Viviendas revealed strong public will for drastically strengthening enforcement measures to combat organized crime in the country.
Police say six people were lined up and gunned down outside a business in this violent border city Juarez. City police spokesman Alejandro Pariente says a written statement “for all rats” was found among the bodies and declared that the killings “will continue.”
Pariente says investigators found more than 100 bullet shells at the scene. He says no arrests have been made.
Again in Tijuana this past week, at least five people are dead following a clash between soldiers and gunmen protecting a safe house near a junior high school in a residential area of the city. Concern about recent violence led a medical group to urge a voluntary curfew Wednesday through the end of November, calling for residents to avoid going out after 9 p.m.
This is real terror and it’s happening right in our own front yard and is expected to escalate and U.S. law enforcement fear it’s just a matter of time and we’ll be dealing with it right here at home. There already have been reported suspected attacks by these Mexican terrorist in Phoenix Arizona, Las Vegas Nevada, Atlanta Georgia, Dallas Texas and Birmingham Alabama.
U.S. drug czar John Walters said Friday that Mexico’s drug cartels are crossing the border to kidnap and kill inside the United States.
Walters, director of the White House Office of National Drug Control Policy, was in Mexico for two days to discuss efforts with local officials to stem killings, weapons trafficking and money laundering by Mexican cartels and their U.S. associates.
“Some of these groups not only engage in crime and violence not only in Mexico and along the border, but they come across and kidnap, murder and carry out assassinations,” Walters told reporters. “These groups do not respect the border.”
Walters praised Mexican President Felipe Calderón for mounting a police and army offensive against the cartels, which he called “terrorist criminals.”

What are Alternative Fuels
In the simplest form, an alternative fuel is one that is not produced by using crude oil. They are simply fuels that replace conventional gasoline as a means of powering vehicles. Alternative fuels have desirable energy efficiency and pollution reduction features. The 1990 Clean Air Act encourages development and sale of alternative fuels.
More specifically, the Energy Policy Act (EP Act) of 1993 gave a more in-depth definition of what they consider to be alternative fuels. The United States Department of Energy recognizes the following as alternative fuels:
Mixtures containing 85% or more by volume of alcohol fuel, including methanol and denatured ethanol
Natural gas (compressed or liquefied)
Liquefied petroleum gas (propane)
Hydrogen
Coal-derived liquid fuels
Fuels derived from biological materials
Electricity (including electricity from solar energy)
100% Biodiesel (B100)
Pure biodiesel (B100) is considered an alternative fuel under EP Act. Lower-level biodiesel blends are not considered alternative fuels, but covered fleets can earn one EP Act credit for every 450 gallons of B100 purchased for use in blends of 20% biodiesel or higher.
Through the Alternative Fuel Petition Program, third parties can petition the Department of Energy to add alternative fuels to the above list. People are always on the lookout for new ways to combat rising fuel prices and develop fuels that are not only good for the environment, but for the consumer’s checkbook as well.
Basically, alternative fuels include methane, propane, ethanol, and compressed gas among others. We’ll examine some of these a little later in the book, but alternative fuels don’t fall into one compact category other than the one that defines them as an option over gasoline.

A Look Into the Past of Alternative Fuels
The history of alternative fuel can be found way back in the 1900’s but as a result of political and economical factors, the development of alternative fuels was short lived. Fossil fuels are still the foundation of the economy but in the 1970’s, there was a extreme fuel shortage in America that led to taking a serious look at alternative fuels.
Due to an over reliance on fossil products, America were at the mercy of foreign countries with oil reserves to run their economy. This led to a paradigm shift when in 1973, OPEC reduced its production, corresponding causing an increase in oil prices. As a result the world has to take a serious view of the reliance and in 1978, diesel engines began regaining popularity as well as other alternative fuel such as biodiesel.
Now, almost 3 decades later, the world is dawn to many other sources of alternative fuels. Ethanol is one of the fuels that is taken its place and is essentially make from grain. Researchers have come up with a certain form of grain alcohol that can power a combustion engine as well as oil-based products but more kind to the environment. In addition, it is much economical to produce too besides creating more jobs for corn farmers.
Other forms of alternative fuels are methane, propane, and hydrogen that can be used to power modern vehicles. But to effectively run such fuels on traditional engines, modifications have to be done. Thus, this led to the development of the modern alternative fuels vehicles.
Technology and environment have much less to do with the development of alternative fuels than mainly politics. To a certain degree, it is true as politicians, being politicians, tend to lean on mass opinions. Different types of alternative fuels continue to make big stride and will continue as fossil fuels are limited and will in due course dry up. Being environmental conscious is essential but alternative replacements are necessary and scientists will continue to make alternative fuels technologies more cost effective as well as efficient to use so that the masses will take to it.
