It has been called the worst UK legislation ever. But why has the proposed regulation of investigatory powers (RIP) bill been under such close scrutiny? Because in my view it will wreck all the e-commerce hopes for the UK.
The new economy undoubtedly means we need a revised framework for the legal interception of communications. But this bill wonÂ?t make Britain a better place to live and it will certainly not create the best environment in the world for e-commerce.
Tony Blair had to endure slow handclaps from the WomenÂ?s Institute recently. But that mild criticism will be nothing compared to the furore from business and individuals with the RIP bill finishing in the Lords.
Industry is waking up to the enormity of this Â?Big BrotherÂ? bill, which many see as an attack on basic human rights and civil liberties. As the MD of leading e-commerce financials software house Access Accounting Ltd Alistair OÂ?Reilly says, Â?We need a law that suits an aspiring e-commerce leader. We need to kick this proposed legislation out!Â?
The way I see it RIP proposes policing powers to demand from businesses and individuals the electronic keys that will unlock all oneÂ?s traffic to date. Though earlier attempted legislation to secure copies of decryption keys failed, and other countries wanted nothing to do with this type of legislation, the British Government ploughs on with it regardless.
The Bill means :
The government is still trying to secure a general right of access to the encryption keys for a wide range of authorities and for loosely defined purposes. Furthermore if you had to hand over the keys you can’t tell anyone, even your boss, that any of this has happened. Even though this clause may be amended this has no parallel anywhere in the world.
Under RIP if you donÂ?t have your encryption key anymore youÂ?re liable to up to two years jail unless you can prove to a court that the key was lost or destroyed. Imagine if you had to do that everytime you lost a credit card PIN number!
If it becomes law every internet service provider will have to install a black box – this means MI5 and the authorities can monitor the patterns of all the e-mails, and web sites that companies click into. This sounds more like a sinister John Le Carre spy novel than e-commerce initiatives. All this can be done continuously without any warrant being produced. On production of a warrant, the authorities can force businesses and individuals to surrender any keys used to encrypt our e-mails so they can read them.
The proposals seem to have been devised by paranoid androids who have put us on an information war footing. The rest of the e-world plans a prosperous future based on trust in industrial strength security, without unnecessary interference. We want the Government to say how a draconian measure like this will help make the UK the best place in the world to do e-commerce. At the moment the GovernmentÂ?s Â?snooping billÂ? as it has been titled is making internet companies consider moving their business overseas. Web authority Esther Dyson has added if it becomes law it would turn Britain into a police state.
As an e-commerce software house Access Accounting Ltd fully supports protecting public interest. We would do this by allowing a single government agency set up for the purpose to apply to a court for individual permission to demand an individual decryption key for one time use. They should only use this in the event that they have sufficient grounds and evidence to support such a demand. The police already have this sort of legislation for phone tapping and entry of premises. This way the legislation could go through without creating such public outcry.
If this key concern is taken out of the RIP Bill, then the bill could be a good way to protect industry and the public from illegal trading and tax avoidance over the net. But lets wait and see how much might be re-written before we get too excited.

Fathers & Families Announces Opposition to Lt. Gov’s Dog-collar Bill

Fathers & Families, a non-profit organization of 2,000 men and women in Massachusetts who support equal rights and responsibilities for mothers and fathers after divorce, today announced its opposition to Lieutenant Governor Kerry HealeyÂ?s proposed Â?Act Relative to Enhanced Protection for Victims of Domestic Violence.Â? Under this bill, any violator of a domestic restraining order could be required to wear a satellite tracking device similar to an electronic dog-collar. The device would signal authorities whenever the wearer came within range of certain exclusion zones, such as the complainantÂ?s home or workplace.
Massachusetts courts issue around 40,000 domestic restraining orders each year. Many of these are bogus. For instance, Attorney Elaine Epstein, former president of the Massachusetts Bar Association, wrote, Â?The facts have become irrelevant. Everyone knows that restraining ordersÂ?are granted to virtually all who applyÂ? In many cases, allegations of abuse are now used for tactical advantageÂ? [in divorce]. And the Massachusetts Supreme Judicial Court has tacitly agreed with this view by writing that we must Â?resist a culture of summarily issuing and extending these orders.Â? Most violations of restraining orders are non-violent, such as placing a telephone call about a sick child.
According to Dr. Ned Holstein, President of Fathers & Families, the bill is Â?a Robocop nightmare.Â? Â?Getting tough on crime always makes a good sound bite, until you look at the details. This bill takes Massachusetts down the slippery slope towards a police state, subjecting non-violent offenders to 24/7 surveillance, humiliation, and false alarms due to inaccurate devices and outdated exclusion zones. It piles on still more penalties for non-violent offenders, while doing nothing about the tens of thousands of innocent men who labor under fraudulent restraining orders. Finally, it diverts resources from those who really need protection, as police race to the sites of trivial, accidental or non-violent infractions.Â?

Here we go again. Alex just doesn’t seem to like these calls. I thought it was quite odd that this part is missing from the? Alex Jones’ channel upload for 08-08-2010 – what’s up with that? It was also extremely difficult to get from prison planet; there was no wmv for that day and the mp4 was jacked. Why doesn’t Alex cover Rod Class and friends serving 541 Congress members notice that they are doing buisness as a corporation and it’s going to be brought b4 the Hague? Alex always said to do our own research so I’m just asking questions here. By the way, the congress critters are all in default including Ron Paul. As much as I have always loved what Ron Paul has stood for, he works for the corporation. Why doesn’t Alex cover that?
