Social Security & Economic Security to All Citizen of India & Universe

Indian Social Security, an NGO conceptualized & supported by social workers of various states, NGOs, Professors of IIT and students, has filed a Public Interest Litigation with Supreme Court that is heard on November 17,2008 .This PIL demands a ‘National Database System’ to achieve Social Security & Economic Security to all citizen of India with a single ‘Centralized National Database Number’ containing all the information of each citizen in order to maintain an authentic data to curb down fake identity, infiltration, terrorism, poverty, corruption, tax evasion.

Explaining the objectives of this PIL Gurbinder Singh from ‘Indian Social Security’ said, “System for People will be created by People.”

He said that social security is still a distant dream as present system of governance has no measures of adequacy for fair distribution of welfare schemes like subsidies to deprived citizen of the country when they are in need due to non- availability of authentic data of the Location wise authentic data of Deprived Citizen. Instead, In Current Situation, all the social benefits are delivered vide a channelized structure of Hierarchy Structure of Government Bodies, Ministries, Departments, Block Panchayats, Local authorities, Where the Purpose of the Benefits are evaded in Corruption, Thus leads to major atrocities for the deprived Citizen..

If social security & Economic Security is to be ensured to each and every deprived citizen of this country, A national Database is a basic need of Government. Nobody can deny this fact. Even our Constitution endorses it vide Citizenship Act 14A. A ‘National Database System’ will be a first step in this direction,” he said. He highlighted Chief Justice, the fact & importance of National Database to be the Base of Governance, He added, that even a School or Institution, or Supreme Court cannot run without authentic Database.

Further He said “The intentions of the Central Government are limited to provide social and economic security to its employees only rather than all citizen of India. Over 55% citizens live below the poverty line, Over 40% Indian kids are malnourished,” he added, that Government maintained data of their employees for their Social & economic Security but Why has there been no intensions for even maintaining a Authentic Database of rest of their tax Payer Citizen.

He also said that the main security agencies and public policing agencies in India do not have any centralized data of citizens to curb down the sensitive problems of terrorism, infiltration, and the movements of violent organizations. According to him, this non-centralization of citizen data has increased the burden on law enforcement machinery.

Singh expressed that the central governance has no method to deal with natural calamities in terms of appropriate subsidy distribution system to the affected citizens as no authentic data of any given affected area is available with them. As a result of this, needy people do not get any relief in spite of the support of funds and relief measures.

This database system will lead to increased taxation, direct delivery of subsidy & other social welfare benefits like Old-Age pension to citizen, fair polling, secularism, speedy implementation of law & justice, said Singh.

He Presented the fact to Chief Justice that:
“ If most of the Developing & Developed countries including Argentina, China, Brazil, other 50 countries are having social security mechanism to create a prosperous culture of equality, fair distribution of resources, speedy Justice, control of human intensions of corruption, then Why not in India?” asked Singh.

Singh Added,
Your Honour This is demotivationg, National database is the base of Governance, even a school or supreme court cannot operate without a database, then how come country of billion does not needs his kind of database. This is dilemma of India that there are 35 separate smart cards, each card is a burden to the taxpayer money of minimum about 1000crores – Rs.5000 crores FOR EACH CARD on average per year, with E Governance of Centralization this cost can be reduced to 25 times the existing cost

(According to Chief Statistician of India, Mr. Pranab Sen – said in an interview on 30th July in Lok Sabha Channel, That The available data with the govt. is Inadequate, Therefore How can the Policies for People be accurate, credible & Factful.)

Singh said “Last statement your honor, Government has most e-governance implementations in collection of taxes, others but Government has not initiated any single move as far as e-governance strategy in delivering that money to the deprived people”

Gurbinder Singh opined that the motive of making an effort for social security through the proposed ‘National Database System’ is based on a fact that the purpose of prosperity in a country of billions cannot be achieved without the wisdom and creation of positive social and economic systems in the direction of humanity.

Wisconsin Property Taxes – The Necessary Information.

The General Prosecutor launches new investigations in relation to public funds and other irregularities perpetrated after the arrest of Ali Massaad

The appearance of the accused and the lifting of the sequestrations are the main issues of this case

This case locally known as the “great corruption case of the Damietta Containers” and internationally named the “Damietta Gate” has shaken the Egyptian, Arab and international public opinion.

From the first audience, three of the six accused confessed, the third, the fifth and the sixth and acknowledged having been involved in the briberies paid to Ali Massaad, whereas the latter denied at the beginning the whole matter.

The six accused, Ali Massaad, chairman of the board of directors of the Damietta Container Company, Jihad Anis Dagher, employee of Leader Company, Nabil Elie Bassil, CMA-CGM regional Finance and administrative director, Mostapha Mohamad Khalil Abdel Monhem, Director of the Damietta subsidiary, Jamal Abdel Razek Abdel Sadek and Ahmad Mahmoud Ahmad Yacoub have been referred to the Penal Court by the General Prosecutor (financial section), and the second hearing is set for November 9th for a contradictory debate and confrontation with the prosecution’s witnesses who will appear before the court for corruption and misappropriation of public funds.

The most surprising aspect of this case it seems is that Ali Massaad’s successor as head of the Damietta Container Company is following the same methods as his predecessor, a matter which compelled the General Prosecutor to launch a second investigation pertaining to the period following Ali Massaad’s management of the company. This investigation has been postponed following the juridical holidays and the promotion of prosecutor Wadih Hanna Nached.

Ali Massaad, known as the “Bey”, is now in prison.

This case is about corruption, account manipulations, financial fraud and a plot between the Damietta Container Company and French company CMA-CGM presided by Lebanese national Jacques Saade whose corporate headquarters are in Marseille. The file that is being dealt with by the Court of State Financial Security in Egypt pertains to the misappropriation of funds that could reach up to 20 million dollars.

The main accused is being held in temporary custody while awaiting the outcome of this case.

This case is of major interest in its Egyptian, Lebanese and French ramifications.

The Egyptian media has released important pieces of information revealing that this is not an isolated corruption matter in the shipping sector in Egypt. The former General Prosecutor Maher Abdel Wahed has already ordered the chairman of the board of directors of the Damietta Container Company, Ali Massaad, to be placed in custody and his personal assets seized until the end of the investigation; the latter decision has been notified to the Central Bank of Egypt, the Finance Directorate and the land registry.

The General Prosecutor opened an investigation following a declaration presented by the president of the Central Accounting Agency regarding the statements of accounts pertaining to the company owned by the holding company for land and shipping transport presided by the General Mohammad Youssof already indicted in the case of the seizure of the “Salem 2” vessel in the port of Alexandria. The president of the Court of Appeal of the district of South Cairo, Adel Joumaa had set the next hearing to last May 29th in order to take a decision as to the verdict of the General Prosecutor.

The investigations have revealed a plot between engineer Ali Massaad and the managers of the foreign shipping company regarding the signature of an agreement according to which the foreigh company could benefit from exceptional rebates to the detriment of the Damietta Public Company that could reach up to 5,5 million dollars.

This scandal is worrying Egyptian public opinion as well as the political scene, as it happens to occur after other scandals such as the one related to the Directorate of Transport, the Bank of Cairo and the robbery of steal and other metals.

The investigations have proven the existence of a plot between the first accused Ali Massaad Saad and the President of the foreign shipping company, which resulted in the disappearance of 6 million dollars from the Egyptian treasury. It has been established, following the house search, that the accused regularly received briberies from France.

In a surprising rebounce, the investigation revealed that the managers of the international shipping company based in Marseille (France) reimbursed the amount of 3,1 million dollars by bankers cheque to the Damietta Company following a compromise aimed at smothering the case, after that the General Prosecutor started a legal action against this company and seized the assets of Ali Massaad. This payment did not put an end to the legal actions but led to the discovery of another aspect of this case namely the direct involvement of the French company in corrupting Egyptian officials.

Despite CMA-CGM’s denial of any involvement in this corruption case declaring that an internal investigation is underway in coordination with the Egyptian authorities, the Sunday Express newspaper revealed that CMA-CGM presided by Jacques Saade, paid 10,000 dollars per month to Massaad, and has reimbursed as reparation 3.1 million dollars to the Egyptian port of Damietta.

In a statement made by Jacques Saade to the same newspaper, he mentioned that these people were paid by the CMA’s Egyptian subsidiary, that no transfers were made by the French head office and that his company was investigating in coordination with the Egyptian authorities. Various managers were heard including the accountancy manager.

According to the Sunday Express, this is an extremely serious situation and other countries, including the United States, are being worried. It seems that political pressures have been exerted in order to prevent CMA-CGM from acquiring from the English company P&O its shares in the American port of Dubai for security reasons. The American authorities are undertaking an investigation regarding this matter.

Other pieces of information collected in parallel to the secret investigation indicated that many points in this case were still not clear. The most important element that has been discovered until now is the false contract -which is the main aspect of the investigation- signed by Farid Salem, CMA-CGM general manager and brother-in-law of Jacques Saade.

It has been revealed that Abdel Razek is the financial manager of CMA-CGM in Egypt, presided by Jacques Saade, as indicated by the social security registers.

All the evidence indicates that the financial offenses have been perpetrated by the chairman of the Damietta Company, in addition to the irregularities within the contract signed with the shipping line in Marseille.

In an Al-Ahram article of May 26th 2006, it seems, according to the investigations undertaken by the financial control services [official body], the principal accused perceived important amounts on a regular basis in exchange for those irregularities. The former General Prosecutor Wadih Hanna Nached issued search-warrants in the offices of the said shipping company (CMA-CGM) in Alexandria, which resulted in the seizure of numerous pieces of evidence confirming the transfer of important amounts from the accounts of the latter company in favor of the accused.

According to the “magazine Rose El Youssof” that published the result of a long investigation on the subject, the chairman of the Damietta Company is the owner of two palaces in the city of Damietta on the river Nile as well as a dozen estates and three villas in the touristic village of Yasmina in Port Said, in addition to five hectares of agricultural land in the latter city, 20 million Egyptian pounds deposited in bank accounts in his name, his wife’s and children’s and a number of bank accounts abroad which inventory is not yet known.

It was mentioned in the article that Ali Massaad had a nickname, “the Bey”, to the order of whom checks were drawn up.

The investigations revealed that the number of containers CMA-CGM sent in transit through the port of Damietta, did not exceed 70,000 teus for the last 12 months allowing the French company to benefit from rebates of the amount of 5,5 million dollars. This led them to illegally modify the contract with the Damietta Company by paying briberies in addition to the monthly remuneration of Ali Massaad.

Rose El Youssof added that Ali Massaad pretended that he made his fortune in Saudi Arabia, where he worked for 12 years, and in Bahrein, where he worked 5 years; but was not able to keep the evidence that would clear him.

A surprising aspect is that he appeared before the court, which ordered the seizure of his assets and his wife’s, wearing bad quality clothes, in an attempt to conceal his wealth. The most astonishing is that the law firm handling his defense is one of the major firms specialized in shipping matters in Egypt.

The investigation is moving forward with the hope to shed light on other thorny aspects of this case. There is a strong probability that the General Prosecutor would prosecute Jacques Saade, chairman of CMA-CGM; one more element that adds up to the conflict as to the ownership of this company and increases the legal stranglehold around Jacques Saade.

Damietta “Gate” to date is the last link in a series of legal proceedings facing Jacques Saade.

If this case is taking an official aspect in Egypt given that it involves a number of irregularities, corruptions and misappropriation of public funds, other legal proceedings have been launched in many countries in which the conflict between the brothers Jacques and Johnny Saade is raging around the ownership of CMA-CGM, the first shipping company in France and the third worldwide.

Six years after the signature of a contract on September 16th 2006 between the two parties aimed at ending the conflict but which deprived Johnny Saade of his legitimate rights due to a deceitful set-up, new facts could reveal unexpected developments in the coming months very probably in favor of the latter.

The internet site www.mistralholding.com owned by Johnny Saade’s company Mistral Holding s.a.l., contains a huge amount of documents, compromising reports and legal evidence, that explains in detail the conflict between the two brothers which is being reported at the top of the news in the Lebanese, arab and international press. Among these documents a report issued by the financial expert Antoine Gaudino explaining the circumstances that led to the said conflict.

One can read in the report that the conflict between the two Saade brothers as the major shareholders of the CMA-CGM Group is mentioned by the media as a family feud due to Jacques Saade’s statements, but Johnny, who owns 48.44% of CMA’s shares accuses his brother of hiding information in general and more specifically regarding transactions initiated by Jacques Saade in France and elsewhere.

The conflict actually starts by the lack of transparency during the acquisition of CGM by CMA, and Jacques Saade’s attempt at controlling the group for his sole personal benefit.

The preliminary investigations undertaken by Gaudino on August 29th 1997 at the request of Mistral holding, revealed that the management system established by Jacques Saade on behalf of CMA made Johnny Saade fearful, as major shareholder, of the company’s future.

With further investigations, various fiscal irregularities and others have been discovered, and are part of the conflict between the brothers.

The main historical stages of this conflict are the following:

The Limited company CMA (Compagnie Maritime d’Affretement) was created by brothers Johnny and Jacques Saade on September 8th 1986 and registered at the RCS of Marseille on April 8th 1987 under number 340 353 911.

The initial capital was FFr.250,000. It was to be increased following various share capital increases in 1986, 1987 and 1993 as well as on May 26th 1994 further to an extraordinary general assembly to reach FFr. 60,000,000 divided in 600,000 shares with a nominal value of FFr.100.

At the latter date and according to the shareholders’ registry, the shares were distributed between three Lebanese companies: Merit s.a.l., owned by Jacques Saade, 48.41%; Mistral Holding s.a.l., owned by Johnny Saade, 48.41%.

The six shares attributed to the “Jacques Saade Family” are held by Mr. Jacques Saade, his spouse Mrs Nayla Salem, his daughter Tania, his son Rodolphe, his brother-in-law Mr. Farid Salem and Mr.Tristan Vieljeux.

The three Lebanese companies are all registered at the Beirut registrar of Companies and domiciled in the same city and the same address.The company Rodolphe Saade & Co is owned by Jacques Saade and Johnny Saade, 50% of the shares each, respectively through Merit s.a.l. and Mistral Holding s.a.l.

CGM s.a. (Compagnie Generale maritime), with a capital of FFr. 1,275,948,600 and registered at the RCS of Nanterre under number 562 024 422, has been transferred by the French government to the private sector by ministerial decision on October 21st 1996.

The capital of CGM is distributed as follows: 90% of the shares came to be held by CMA, 6% personally by Jacques Saade and 4% between three other shareholders.

CMA got 96% of the CGM shares whereas the 4% remaining were held by three other shareholders; and Jacques Saade’s stake reached 51% whereas Johnny’s, through Mistral holding, did not reach 49.9%.

The first findings revealed a certain number of irregularities, the most important of which related to general assembly meetings.

An extraordinary general assembly was held at CMA head offices on December 12th 1996 without letting Mistral Holding s.a.l. have the opportunity to participate. This assembly was aimed at granting the board of directors the right to increase the share capital, in one or many times. This authorization to the board of directors was valid for a period of five years and aimed at increasing CMA’s capital from FFr. 60,000,000 to a maximum of FFr. 135,000,000.

The report added that until December 12th 1996 CMA’s management has always convened Mistral holding s.a.l. by rapid courier (DHL) and simultaneously by fax, given postage delays to Lebanon. In an unusual manner, the convening to the extraordinary general assembly meeting of December 12th 1996 was sent to Mistral Holding s.a.l. on November 26th 1996 by recommended letter with acknowledgement of receipt.

Everything was done in order to prevent Johnny Saade to be informed in due time and therefore to participate to the main decisions to be taken including the share capital increase.

It is within the above-mentionned context that Johnny Saade seized the Tribunal of Commerce of Marseille who designated on December 23rd 1996 a judicial “huissier’ in order to get the documents pertaining to general assemblies and board of directors held by CMA.

Following this judicial decision, Mr Johnny Saade was able to raise various irregularities. Four Board of Directors meetings were held on June 7th, September 20th and November 14th & 15th 1996 without Mistral Holding s.a.l. being ever convened whereas the minutes of meetings stipulated that Mistral Holding s.a.l. was “absent and excused”.

A general assembly was held on March 27th 1997 in cancellation of the share capital increase decided by the general assembly of December 12th 1996.

This did not however erase the irregularities due to the share transfers and the acquired majority to the benefit of Jacques Saade which jumped from 48,41% to 50,001%.

Irregularities were noticed regarding the presentation of balance sheets. It appears from CMA’s balance sheets in the offer for the acquisition of the CGM of October 3rd 1996, that CMA was in good financial health, that it increased its shareholders’ equity funds, reaching FFr. 700 million and the CGM acquisition project would allow the financial rehabilitation of the latter no later than 1999.

The findings made on certain accounting entries called in question the validity of the level of CMA’s shareholders’ equity which were lower than the reality. These shareholders’ equity funds were much lower than the FFr. 200 millions and CGM’s takeover was a juicy business deal that Jacques Saade wanted to keep for himself to the detriment of his brother Johnny.

This report mentioned, backed by the necessary documents and figures, that the filed balance sheets were false and did not reflect the truth about CMA’s accounts, a matter that was to jeopardize the future of the company and the interests of Johnny Saade, its main shareholder.

This report mentionned that Jacques Saade made his brother Johnny become a minority shareholder through successive steps and by premeditation in order to prepare the acquisition of CGM to his sole personal benefit; the report also summarized the various attempts of Jacques Saade to escape legal proceedings which were accumulating every day.

Of importance in this conflict is the re-opening of a financial investigation by the Paris Tribunal regarding the accounting irregularities and fiscal fraud perpetrated by Jacques Saade in managing CMA-CGM.

Other information indicate that Egyptian courts of law are entangled in an important corruption file involving the Port of Damietta since the 90s and are attempting to determine the scale of corruption involving the representatives of the French shipping line on behalf of their managers in France. While awaiting new developments, the director of the Port of Damietta has in the meantime been arrested.

On another level and following the penal lawsuit filed by Mistral Holding, Paris Tribunals (France) have launched legal investigation regarding the CMA-CGM balances sheets that are allegedly false. The investigation has been entrusted to two prominent magistrates in France. The aim of this investigation is to shed light on the possible fiscal fraud and concealment of the real profits, a matter that goes back to the signature of the contract that has put an end to the conflict between brothers Jacques and Johnny Saade.

Finally, we can add to this multi-faceted judicial file that is surrounding Jacques Saade, a matter that is worrying investigators near the General Prosecutor of Lattakia in Syria. It involves the falsification of official documents, the use of false documents and usurpation of legal capacity, involving Choucri el Khoury that seems to have acted on behalf of Jacques Saade.

Every day reveals a new case on the arab and International level in the long story of Syrian national Jacques Saade, chairman of the board of directors of the French company CMA-CGM.

The lawsuit of his brother Johnny R.Saade is still under deliberation near the tribunal of cassation regarding the production near a notary public by Jacques Saade and Lebanese lawyer Choucri El Khoury of a false power of attorney related to the partition of his sole benefit and to the detriment of his brother, of a building situated in Lattakia.
This partition was forbidden by the magistrates.
This case became penal near the Investigating Judge in Lattakia and the General Prosecutor issued an accusation against Jacques Saade and Choucri El Khoury for forgery offence and the use of official documents. The case is under course near the Higher Council of the court of cassation.

A far as Egypt is concerned, the Egyptian and Lebanese press as well as some television networks have reported that a major contract forgery case has broken out between the French company CMA-CGM signed by Farid Salem, a close colleague of Jacques Saade, and the Damiette Container Company, a public-sector corporation, to the benefit of Jacques Saade and Farid Salem who profited from important amounts to the detriment of the Egyptian treasury; in addition ot their committing briberies.
Whereas CMA-CGM was forced to return to the Egyptian state the sum of 3 million Egyptian pounds in exchange for allowing Jacques Saade and Farid Salem from leaving the Egyptian territory and lifting of a seizure decision against their assets wherever they may be.

The payment of this amount falls within a compromise aimed at removing the legal proceedings initiated by the General Prosecutor against them and focus the responsibility solely on VMA-CGM employees, who are not the personal beneficiaries of this corruption case.

However the company Mistral (Holding) s.a.l., CMA-CGM shareholder, has recourse to the Egyptian judiciary as a civil party with the aim of denouncing the people involved in this corruption case and benefiting from Egyptian public funds. It is to be noted that such crimes are subject to the imprisonment and penal servitude for life.

This case had consequences outside Egypt. The ministries of Justice and foreign affairs of the United States and Great Britain undertook investigations suspecting that this case went beyond corruption and the diversion of public funds. The arab and foreign press reported those facts, among which: The Sunday Express, Lloyds, the Wafd (Egyptian), AL Akhbar (Egyptian), Al Joumhouryah (Egyptian), Al Ihtidal (Syrian), Al Kifah al Arabi (Lebanes), Al Balad (Lebanese) as well as others…

Jacques Saade was deeply surprised of Mistral holding’s intervention at the court session of the penal tribunal on September 3rd 2006 which was adjourned to November 11th 2006 while at the same time keeping in custody the director of the Damiette company, engineer Ali Massaad and maintaining the warrant for the arrest against the regional manager of CMA-CGM, Nabil Bassil, fugitive, who is suspected of hiding in Jacques Saade’s offices in Beirut. Despite Jacques Saade’s attempts at denying any involvement following the clear confessions of the accused.

It is to be noted that the Egyptian judiciary, the General Prosecutor for financial matters is waiting for the return of Jacques Saade in order to arrest him.

It is expected that further developments will occur in the coming days especially that other similar corruption cases have been dealt with near the public funds general prosecutor in Egypt, establishing a new corruption case involving the Syrian national Jacques Saade acting on behalf of the French company CMA-CGM in Egyptian ports.
A number of lawyers of Jacques Saade are repeatedly coming to Egypt in order to find an unofficial compromise and put pressure on the Egyptian press in order for it to quiet down, and lead to a discreet closing of the file.

The Alam al Mashaeer newspaper (Egyptian), close to the investigation, reported that it was unlikely that Jacques Saade could be innocent of the crime of corruption given that the amount of the bribes is substantial and could not be undertaken by simple employees, especially that Jacques Saade personally benefited from this deal. It is his close relative Farid Salem who signed,on behalf of CMA-VGM, the false contract with the Damiette company.

As far as France is concerned, it is interesting to note that lawsuits are starting to encircle Jacques Saade as is reported by the French press. A new investigation has been initiated by the General Prosecutor in France and two investigative judges have been designed I the matter following a penal petition filed by Mistral against Jacques Saade for producing false accounts and under-estimated account projections in collusion with the company’s auditors.

The above fits with the illegal transfers to the benefit of the personal accounts of Jacques Saade through his range of personal companies such as CMA International and Container Management advisors, which have been under liquidation with the aim of concealing those offences; however legal proceedings have put a halt to the liquidation process of those companies.

Le Journal du Dimanche and La Lettre du Sud have written in this respect and added that legal proceedings against Jacques Saade are intensifying every day and the noose is tightening around him.

Mexican drug cartels, Hezbollah (Party of God) and other Islamic terrorist groups are joining forces in Mexico. Hezbollah is synonymous with terror, suicide bombings, kidnappings and beheadings. No wonder the criminal organizations in Mexico seem to have adopted many Middle Eastern terrorist tactics with kidnappings and beheadings happening throughout Mexico.

According to authorities global Islamic terrorist have moved into Mexico and other Latin American countries to open the door for Mexican cartels to have excess to Afghanistan cocaine at bargain basement prices, those profits from those sales are being passed on to Hezbollah and other terrorist organizations worldwide to attack the states from within. Hezbollah is known to be raising money for their cause in the U.S and some Americans say they have brought suite case dirty booms into the U.S. and are waiting for further instructions. Hezbollah is currently training Mexican drug cartel enforcement gang members. They are teaching them their gorilla terror tactic’s that they use in the Middle East. One high ranking Mexican Army officer who will at his request remain anonymous says Hezbollah is now believed to be training Mexican drug cartel enforcers the art of bomb making. It is now feared that there will soon be car and truck bombings of Mexican solders at the many road blocks that they have set up throughout Mexico, their barracks, police stations and even government buildings are at risk. The training is designed to combat the Mexican Army and police, American Special Forces and DEA agents now operating in Mexico.

According to Mexican officials Hezbollah is training the opposition to the Mexican Army and is starting to be seen throughout the country. There are new reports of late, of hit and run tactics against Mexican military set up road blocks where both attackers and Mexican solders have been killed.

Homeland Security has said that there are Hezbollah members operating in the U.S. and it is reasonable to believe they are in contact with other Hezbollah in Mexico and around the world. In addition to other terrorist attacks, Hezbollah has been tied to the 1983 Marine barracks bombing in Beirut that left 241 U.S. personnel dead, and the 1996 Khobar Towers attack in Saudi Arabia that left 19 U.S. servicemen dead.

One U.S. law enforcement official, speaking on condition of anonymity, says there is considerable forensic evidence tying Hezbollah bomb experts to roadside explosions in Iraq.

Dennis Lormel, who founded the counterterrorist financing program at the FBI, says the United States has been a cash cow for Hezbollah.

“They raise funds through business fronts, through criminal activity, use of shell companies and through fundraising mechanisms,” he says.

Before September 11, 2001, Hezbollah was responsible for more American deaths than any other terrorist organization. Hassan Nasrallah, the group’s secretary-general, recently proclaimed, “Death to America was, is, and will stay our slogan.”

In spite of all that, the terror and violence in Mexico, Mexican officials are encouraging Americans to visit Mexico in a new tourist campaign. But with more than 1,200 people having been killed this year alone in Ciudad Juárez that is not happening. Juarez has a population of 1.5 million people many depending on American tourist dollars. But many El Pasons who live in El Paso a bordering city of about 350,000 say they are just to frighten to risk going into Mexico.

Mexico’s violence of terror along with the world banking and financial crises that are happening today are forcing drastic changes in the rate of tourism to Mexico, especially border regions from the Gulf of Mexico to the Pacific Ocean. Mexico has been heavily dependent on tourism and American investors and both are drying up. Oil and drugs are now Mexico’s official and respectively unofficial main stay for what economy they have.

From Brownsville Texas to San Diego California the drug-related dangers and violence is so staggering that the country has been declared off-limits to all U.S. Military. Residents on the American side of the border have told the Laguna Journal that they are afraid to cross over to visit family, shop or conduct business anywhere along the border.

Violent spillover from crime-ridden Mexican border cities are a growing concern for Americans. With cartel-related killings in Chihuahua alone now topping over 1200 for the year, officials in the states are increasingly concerned about “spillover” of crime from neighboring border cites. In El Paso, real effects are being felt at the city’s hospital, where officials report dozens of cases of individuals wounded over the border in the Mexican state of Chihuahua being treated at their facility.

Just last week the State of Morelos Deputy A.G. for Organized Crime Affairs and two escorts were killed by what appeared to be a well organized paramilitary unit in a car-to-car gunfire assault. The killers then fled in two military style vehicles.

Another significant issue is that now Mexico’s toll of deaths linked to organized crime has reached four thousand so far this year, a historic record. That is more violent related deaths than Iraq and Afghanistan combined.  Mexico is reported to be on track to near 5,000 before the end of 2008, another record. The last one thousand deaths have taken place in 48 days. The first one thousand deaths of the year took place in 114 days, the next one thousand in 72. But seventy days later, it reached 3 thousand.

Iran, Hezbollah’s longtime sponsor, and donations from the Lebanese Diaspora are two sources for a multimillion-dollar budget that pays for the militia’s armed and political wings and for social projects such as money, food and hospitals in Beirut. But investigations around the world have shown that Hezbollah also funds itself through drug dealing, arms trafficking, contraband smuggling and other rackets in the Americas, Africa Europe and elsewhere.

The L.A. Times is reporting U.S. and Colombian investigators have dismantled an international cocaine smuggling and money laundering ring in Bogota, Colombia and Madrid Spain, that allegedly used part of its profits to finance Hezbollah, the Lebanon-based Shiite militia, officials said.

Hezbollah presence in Venezuela is also feared

A couple of armed men arrived at a funeral home in Juarez and opened fire on persons at a service for a man who himself had been the victim of a homicide. Three persons were wounded before the thugs left.

“Worse than Iraq: 38 executed”
During the last 24 hours 38 persons have died in different events caused by members of organized crime; the number has reached 4,052 in 2008 in this country (Mexico), surpassing by more than three times the number of dead in Iraq this year, where they total 1,167.
Just recently, ten gunmen lost their lives after a shootout with state agents in Nogales, Sonora. The police were attacked with fragmentation grenades; three police and three civilians were wounded.

 

The body of a gagged man was found in Cabo San Lucas a known and popular American tourist spot. His fingers had been chopped off. Eight persons have died in Baja California Norte in the last 24 hours, the product of a spiral of violence. (Note: the Baja California Peninsula is divided into two states with the same name; each is differentiated by “Norte” and “Sur”) In the morning the bodies of two men were found, both shot to death out of different events.

 

Just recently two Rosarito police officers were assassinated while on patrol. Twenty kilometers away three other persons were murdered. This is an area where Americans murdered bodies have been found. A related account in “El Universal” (Mexico City) states that violence in Rosarito has cost the lives of seven police and at least a dozen other persons in less than thirty days; it adds that there have been mass resignations of police there because of fear of being murdered. (Note: just some years back Rosarito Beach was a laid back American tourist attraction, peaceful ocean beach town not far from Tijuana and San Diego.

According to Mexico City daily newspaper Reforma’s running tally of cartel-related killings, or Ejecuciones, (executions/assassinations) Chihuahua’s weekly rate of killings remained higher than it was before over two thousand soldiers and federal police were deployed there in mid-March. Seven other crimes took place in Chihuahua; two men were found dead in Hermosillo, Sonora, two in Culiacan and some others in Guanajuato, Guerrero, the Distrito Federal and Taxco.

 

From Aug. 9 to Aug. 15, Chihuahua had an unprecedented 79 ejecuciones, including the gangland-style killing of 13 partygoers in the town of Creel in the Sierra Tarahumara Mountains, a key transit point for drugs en route to the U.S.-Mexico border. Among the dead were several teenagers, a university professor, and a 1-year-old baby.

The previous week, eight were shot and killed during a prayer session at a drug and alcohol rehabilitation center in Cuidad Juárez. These attacks challenge a common perception that Mexico’s escalating death toll is reducible to cartel members killing other cartel members, and have driven local and state officials to publicly question the efficacy of the current campaign against the cartels. In a televised address, Chihuahua Gov. José Reyes Baeza Terrazas said that the massacre in Creel among other similar, recent events throughout the state show that “the strategy and actions for guaranteeing the security of people in [Chihuahua] need to be radically modified.”

Research group Consulta Mitofsky’s annual survey Encuesta Nacional en Viviendas revealed strong public will for drastically strengthening enforcement measures to combat organized crime in the country.

Police say six people were lined up and gunned down outside a business in this violent border city Juarez. City police spokesman Alejandro Pariente says a written statement “for all rats” was found among the bodies and declared that the killings “will continue.”
Pariente says investigators found more than 100 bullet shells at the scene. He says no arrests have been made.

Again in Tijuana this past week, at least five people are dead following a clash between soldiers and gunmen protecting a safe house near a junior high school in a residential area of the city. Concern about recent violence led a medical group to urge a voluntary curfew Wednesday through the end of November, calling for residents to avoid going out after 9 p.m.

This is real terror and it’s happening right in our own front yard and is expected to escalate and U.S. law enforcement fear it’s just a matter of time and we’ll be dealing with it right here at home. There already have been reported suspected attacks by these Mexican terrorist in Phoenix Arizona, Las Vegas Nevada, Atlanta Georgia, Dallas Texas and Birmingham Alabama.

U.S. drug czar John Walters said Friday that Mexico’s drug cartels are crossing the border to kidnap and kill inside the United States.

Walters, director of the White House Office of National Drug Control Policy, was in Mexico for two days to discuss efforts with local officials to stem killings, weapons trafficking and money laundering by Mexican cartels and their U.S. associates.

“Some of these groups not only engage in crime and violence not only in Mexico and along the border, but they come across and kidnap, murder and carry out assassinations,” Walters told reporters. “These groups do not respect the border.”

Walters praised Mexican President Felipe Calderón for mounting a police and army offensive against the cartels, which he called “terrorist criminals.”

Justice Delayed is Justice Denied

Jawaharlal Nehru, on the afternoon of March 19, 1955, while addressing the members of the Punjab High Court at the inauguration of its new building in Chandigarh, said, “Justice in India should be simple, speedy and cheap.” He remarked that litigation was a disease and it could not be a good thing to allow any disease to spread and then go out in search of doctors. Referring to an adage that “Justice Delayed is Justice Denied”, Pt. Nehru stressed that disposal of cases must not be delayed.

Securing Justice – Social, Economic and Political to all citizens is one of the key mandates of the Indian Constitution. This has been explicitly made so in Article 39 – A of the Constitution that directs the state “to secure equal justice and free legal aid for all its citizens.” But the experience of last 57 years shows that the state has failed to dispense quick, inexpensive justice to protect the rights of the poor and the vulnerable. Hon’ble Justice B.P. Singh, a serving Judge of the Hon’ble Supreme Court, spoke on the topic “Justice Delayed is Justice Denied: the Plight of Indian Poor” at Observer Research Foundation and said that “the situation today is so grim that if a poor is able to reach to the stage of Hon’ble High Court, it should be considered as an achievement. It has merely become a court of the rich.”

The justice delivery system is on the verge of collapse with more than 30 million cases clogging the system. There are cases that take so much time that even a generation is too short to get any type of redressal. A brief look at some of the judicial statistics would tell the true story of the state of justice in India today: -

On an average, 50 lakh crimes are registered everyday, which are sought to be investigated by the police.

The pendency of criminal cases in subordinate courts is in the region of 1.32 crores and the effective strength of judges is 12,177.

· The number of under – trials in criminal cases pending in the courts is 1.44 crores and of these over 2 lakh persons are in prison.

· On an average, Courts are able to dispose off 19% of pending cases every year.

The reasons for delay could be attributed to the fact that every case moves from the lowest to the highest level. Too many revisions, bails, applications make five cases of one. The Centre and the State Governments also contribute to the backlog. Not only is the Govt. the biggest litigant but also it creates fresh litigation because it doesn’t honour judicial decisions. Another obstacle to speedy justice is adjournments. As far as the situation in Subordinate Courts is concerned, the infrastructure is non existent and at times the judges have to write judgments with their own hands as they don’t have stenos. Every subordinate judge is caught between oppressive workload and hardly any time or facilities.

Constitution which mandates that the state shall secure that the operation of the legal system shall promote justice, on a basis of equal opportunity and shall ensure that opportunities for securing justice are not denied to any citizen. The Judiciary is bound to shape the processes of the law to actualize the constitutional resolve to secure equal justice to all. A people who are illiterate by and large, indigent in no small measure, feudal in their way of life, and tribal and backward in large numbers, need an unconventional cadre of jurists and judges, if equal justice under the law is to be a reality. If there is breach, judicial power must offer effective shelter. Even if a legislation hurting or hampering the backward sector is passed, the higher courts have to declare the statute void, if it be contra-constitutional. In sum, the judicial process, in its functional fulfillment, must be at once a shield and sword in defending the have-nots when injustice afflicts them. And this must be possible even if the humbler folk, directly aggrieved, are too weak to move the court on their own and a socially sensitive agency advocates the cause. Securing justice – social, economic and political to all citizens is one of the key mandates of the Indian Constitution. This has been explicitly made so in the Article 39-A of the Constitution that directs the State – to secure equal justice and free legal aid for the citizens. But the experiences of last 57 years show that the State has failed squarely on addressing some very basic issues–quick and inexpensive justice and protecting the rights of poor and the vulnerable. That it will take more than 300 years to clear the backlog of cases in Indian courts is proof enough that our criminal justice system is sick, stagnant and in urgent need of a complete overhaul. A committee was set up, a couple of years ago, under Justice V S Malimath to examine changes and its report came, coincidentally, at the time that justice was finally done in the Uphaar Cinema case and just before the fourth anniversary, Jessica Lal’s horrific murder. Both cases draw attention, in different ways, to the glaring flaws in our justice system.

In the Uphaar case it is shocking that it took ten years to establish that the 59 people died because of criminal negligence on the part of the cinema management and the Delhi government. It was clear from day one that nobody would have died had the cinema followed safety rules but because the wheels of Indian justice move at the pace of our national vehicle – the bullock cart – it took ten years for justice to be done.

Causes of Delay:-

Delay in disposition of cases- Due to huge pendency, the cases take years for its final disposal, which would normally take few months time. The arrears cause delay and delay means negating the accessibility of justice in true terms to the common man. The very core of a civil society and rule of law is the provision of justice, but the decision must be delivered within a reasonable time. It is totally unfair if a suspected criminal waits for trial for years and is ultimately found innocent. Similarly, the victim of the crime will be also not satisfied if there is no punishment to the criminal for so long. Only speedy justice could ensure effective maintenance of Law and order. Quality of justice not only promotes peace in the society but also strengthens internal security of the country. There are number of litigations which could be avoided if Govt. officials had taken interest, for e.g. section 80 of CPC require a prior notice of two months to Govt. by a party who wish to sue the Govt. The purpose of this section is to give time to Govt. to settle the matter with such party by taking proper and suitable action, and thereby could avoid unwanted and unnecessary litigation. But the utter failure of Govt. official in taking a quick, bold and suitable action inspite of giving time forces a person to file case.

Strength of Judges are inadequate according to population and bunch of cases. As of January 2005, pending cases in the Supreme Court number 30,000, in high courts over 33.79 lakh and in subordinate courts over 2.35 crore – a totally unacceptable situation. Much of this is due to shortage of judges. The ratio of judges to population is 10.5 to one million, the lowest in the world. Even this low level is not reached because of the accumulation of vacancies in the Benches -140 against the approved strength of 668 judges in high courts and 2000 against 15000 in subordinate courts.4

The infrastructure of the lower courts is very disappointing. Though, the Supreme Court and High Courts are having good infrastructure but this in not the same position with lower courts. The Courts have no convenient building or physical facilities. The executive has failed to provide necessary infrastructure to enable judiciary and function normally. Good library, requisite furniture, sufficient staff and reasonable space are the need of the qualitative justice. In some courts security systems is also not good. The legal profession is one of the most struggling profession but no social security scheme is available for lawyers, some financial aid should be provided to Bar associations or the new beginners by the government. The good working condition of the lawyers would help in the excellence of service and qualitative justice to the litigating public.

Competency of the Other Staff in Court : It should also be kept in mind that not only Judges and Advocates be competent but also the administrative and clerical staff. The clerical staff must be free from all type of corruption. This is the era of computerization. The highly technical and competitive clerical staff will also help in speedy course. We all know how much time is taken in getting merely a copy of the judgment? It is hard that money is used to speed up the process. The bribe giver does not wish, to get anything done unlawfully, but merely wants to speed up the process of movement of files and communication relating to decision. Certain sections of staff concerned do work only after taking money.

Investigative agencies generally delay : The investigation of crime It is generally heard that the accused gets bail as the investigating agency failed to submit charge sheet within statutory period. The combination of several functions, such as crime investigation, riot control, intelligence gathering, and security of VIPs by a single police force has a devastating effect on the criminal justice system. Nowadays, the crime investigation is not immune from the partisan politics. The power of the government to drop criminal charges against the accused has further abused it. The lethargic police investigation is also a ground of slow process of law.

Consider the condition of the poor victims of Bhopal gas Leak disaster, which took a toll of 15000 people. Twenty years had passed to that ghastly incident; still now victims were fighting for its compensation, which fails to measure up the damage caused to them. Consider the terrible situation occurred in August 1991 as massacre of Dalits at Tsundur in Andhra Pradesh. 13 years had passed to that incident, the families of the victims of Tsundur, still await justice for those who died. They say, they will not find any peace until the guilty are punished for their crime. Consider the condition of those girls who were brutally gang raped during the Godhra riots in front of their helpless family members. Consider the victims of Best Bakery case who still awaits justice to be dispensed in their favour but the climax starts with the key witness in the case turned hostile and the entire fate of the Bakery case is in turmoil. Today the victims of the all the above-enumerated cases know full well that the price of truth is extremely high.

 

“Still they are waiting… But for what? Whether all these amounts to justice?”

 

Remedies to Overcome Delay (Suggestions)

I. Talking about the strategies to deal with justice delay, an improved justice delivery system means cutting down the number of adjournments, reducing the time for arguments, keeping a check on review petitions/ frivolous petitions, stopping lawyers extending cases and so on.

II. Punishments should be very stringent and the implementing authorities should be tough so that crime comes down automatically.

III. Lawyers should encourage out of Court settlements.

IV. In case a lawyer looses a certain number of cases, his license should be suspended for sometime so that lawyers refrain from taking up frivolous cases.

V. Govt. Officials should be made personally liable for lapses so that cases against the Govt. are reduced.

VI. The number of appeals to be filed for each category of case should be fixed. Every litigant should not be allowed to go to the Hon’ble Supreme Court. If need be, the law can be changed accordingly.

VII. It is needed to establish a body at national level composed of Judges, Lawyers and Legal academics, which should be charged with a duty to conduct examinations for recruitment to Indian Judicial Service (IJS). Article 233 will have to be amended to confer power on the president to appoint members of Indian Judicial Services on the recommendation of National Judicial Service Commission. The creation of Indian Judicial Service is appeared necessary to get best available talent in the country.

VIII. There is urgently need to improve the basic infrastructure and management of resources. Modern technology and use of computers could also increase the efficiency of the court system. The judiciary has also to learn management techniques through training at all levels. Though, the Supreme Court and High Courts are having good infrastructure but this in not the same position with lower courts. The lower courts are the basic institution of justice and to improve the quality of the justice dispensed with, it is necessary to improve their infrastructure by modern technology. Lack of funds should not be allowed to enter in the way of development of infrastructure, as external security is necessary, internal maintenance of law and order is also necessary for the internal security, national interest, peace and progress. In general budget certain handsome amount could also be allocated to judiciary like defence and education or a separate judicial budget should be placed, like railway budget. The panel of government lawyer should also be on merits not on the basis of nearness to ministers. As the government is the largest litigant, more transparency is required on their part. Govt. counsel should be selected on the basis of merit, efficiency, integrity, by some transparent manner. There should also be some permanent vigilance provision to observe the working of the public prosecutors. Security system in courts also needs improvement for proper confidence of people and fearless functioning of system. Information-counter should be set up in every court for the convenience of litigating public.

IX. Our criminal justice system has the urgent requirement of Independent Investigative Agency. Delay in police investigation is also one reason due to which cases linger on for years. It is, therefore, good to create an independent wing of police force, fully in charge of crime investigation, and functioning under the direct control of independent prosecutors. That wing should be accountable to judiciary and not to particular government of a time. The practice of torture and third degree methods, extra judicial execution in fake encounters may be stopped also when crime investigation machinery became accountable to judiciary. Such type of police wing also became knowledgeable about the type and method of the evidence needed. Hence, baseless cases, which lead acquittal, also could come down. So, there should be co-ordination between police and prosecuting agencies. The early disposal of case also boosts the morals of police force and will save time, which would have been taken in producing arrestee to the court Horn time to time.

X. We have inherited British legal system, British prescribed it at that time, without considering the need of Indian society nor did they consider the practical of the procedure. So, this system is drawn from different sources without seeing the ground realities. Some people today prefer to keep quiet, rather than go to the court of law. So, now this system is more Indianised for making it fit to society. It is heard that in ancient time justice system was very good. The disputes were settled on the spot by delivering justice. But ancient justice proceedings were oral in general and therefore no much record is available. Now we can take modem know-how from the countries, which have best justice delivery system by getting acquainted with the procedure followed there, if fit to Indian society. The civil and criminal procedure codes and the laws of evidence have to be substantially revised to meet the requirements of modem judicial administration. Though most of procedural laws are effective even today but some provision needs revision, especially the civil laws. To lessen the burden of cases, we may introduce the concept of’ Plea-bargaining’ by decriminalization of those wrongs, which can justly be dealt with by compensatory remedies (Compensation to victim like in tort). The institutions involved in justice delivery system such as the police, the prosecution, and the court, prison etc.-requires to be reformed in terms of organization, procedures, resources and accountability. So that, nowhere citizen feels uneasiness. There should be time limits prescribed for adjudication. There should be uniform formats for the appeals and petitions to make the procedure easy. The judgment should be in brevity and clarity. The concept like of public interest litigation is always welcoming, which is affordable to common men. Hence, there is a lot of scope to improve the situation. For e.g. Section 301 Cr. P.c. should be amended to allow the victim to appoint a lawyer of his choice in addition to public prosecutor to defend his case. Similarly, Section 3 13 (3) of Cr. P.C. also be amended so that the accused would be held liable for refusal to give answer or telling lie. The victim will be allowed to cross-examine the accused to elucidate the truth. There must be some fixed time for presentation of written statement, counter claim and reply like the plaint, under the I imitation Act. After all procedural law is meant to further ends of justice.

Conclusion

While the problem of delay looks daunting, it can be dealt with, by having more fast track Courts, making judicial services more attractive thereby attracting good lawyers and filling up all vacancies at various Courts. We can conclude from the above discussion that we should not resort in extra-ordinary hurry-up of cases by whatever means. As justice delayed is justice denied, similarly, the saying, justice hurried is justice buried is equally true. Therefore, sufficient, reasonable and due hearing of every cases with consideration of its circumstances is the necessary requirement of natural justice and balance of convenience. In fact, the untiring efforts put by fear and flavorless Indian Judiciary is doing commendable job of imparting justice in spite of so many difficulties, which created faith of public in the rule. Of law is a great achievement, which really requires deep appreciation. Social justice will be possible only if the entire concept of egalitarian politico-social order is followed, where no one is exploited, where every one is liberated and where every one is equal and free from Hunger and poverty. The proverb ‘Justice Delayed is Justice Denied’ is proved as it is denied to the poorest of the poor. Providing basic necessities to them will amount to Justice because the definition of justice varies from individuals to individuals on the basis of its economic conditions. According to B.P.Singh J the situation today is so grim that if a poor is able to reach to the stage of a high court, it should be considered as an achievement.  Cases should be decided for imparting justice not for the sake of its disposal. Secondly, Arbitration procedure must be utilized as a better option for quick disposal of cases. Finally, to conclude with the words of Lord Hewet as it is of fundamental importance that justice should not only be done, but should manifestly and undoubtedly be seen to be done.

The Mumbai attacks have been dubbed ‘India’s 9/11′, and there are calls for a 9/11-style response, including an attack on Pakistan. Instead, the country must fight terrorism with justice, or face civil war.

 

We’ve forfeited the rights to our own tragedies. As the carnage in Mumbai raged on, day after horrible day, our 24-hour news channels informed us that we were watching "India’s 9/11". Like actors in a Bollywood rip-off of an old Hollywood film, we’re expected to play our parts and say our lines, even though we know it’s all been said and done before.

 

As tension in the region builds, US Senator John McCain has warned Pakistan that if it didn’t act fast to arrest the "Bad Guys" he had personal information that India would launch air strikes on "terrorist camps" in Pakistan and that Washington could do nothing because Mumbai was India’s 9/11.

 

But November isn’t September, 2008 isn’t 2001, Pakistan isn’t Afghanistan and India isn’t America. So perhaps we should reclaim our tragedy and pick through the debris with our own brains and our own broken hearts so that we can arrive at our own conclusions.

 

It’s odd how in the last week of November thousands of people in Kashmir supervised by thousands of Indian troops lined up to cast their vote, while the richest quarters of India’s richest city ended up looking like war-torn Kupwara – one of Kashmir’s most ravaged districts.

 

The Mumbai attacks are only the most recent of a spate of terrorist attacks on Indian towns and cities this year. Ahmedabad, Bangalore, Delhi, Guwahati, Jaipur and Malegaon have all seen serial bomb blasts in which hundreds of ordinary people have been killed and wounded. If the police are right about the people they have arrested as suspects, both Hindu and Muslim, all Indian nationals, it obviously indicates that something’s going very badly wrong in this country.

 

If you were watching television you may not have heard that ordinary people too died in Mumbai. They were mowed down in a busy railway station and a public hospital. The terrorists did not distinguish between poor and rich. They killed both with equal cold-bloodedness. The Indian media, however, was transfixed by the rising tide of horror that breached the glittering barricades of India Shining and spread its stench in the marbled lobbies and crystal ballrooms of two incredibly luxurious hotels and a small Jewish centre.

 

We’re told one of these hotels is an icon of the city of Mumbai. That’s absolutely true. It’s an icon of the easy, obscene injustice that ordinary Indians endure every day. On a day when the newspapers were full of moving obituaries by beautiful people about the hotel rooms they had stayed in, the gourmet restaurants they loved (ironically one was called Kandahar), and the staff who served them, a small box on the top left-hand corner in the inner pages of a national newspaper (sponsored by a pizza company I think) said "Hungry, kya?" (Hungry eh?). It then, with the best of intentions I’m sure, informed its readers that on the international hunger index, India ranked below Sudan and Somalia. But of course this isn’t that war. That one’s still being fought in the Dalit bastis of our villages, on the banks of the Narmada and the Koel Karo rivers; in the rubber estate in Chengara; in the villages of Nandigram, Singur, Chattisgarh, Jharkhand, Orissa, Lalgarh in West Bengal and the slums and shantytowns of our gigantic cities.

 

That war isn’t on TV. Yet. So maybe, like everyone else, we should deal with the one that is.

 

There is a fierce, unforgiving fault-line that runs through the contemporary discourse on terrorism. On one side (let’s call it Side A) are those who see terrorism, especially "Islamist" terrorism, as a hateful, insane scourge that spins on its own axis, in its own orbit and has nothing to do with the world around it, nothing to do with history, geography or economics. Therefore, Side A says, to try and place it in a political context, or even try to understand it, amounts to justifying it and is a crime in itself.

 

Side B believes that though nothing can ever excuse or justify terrorism, it exists in a particular time, place and political context, and to refuse to see that will only aggravate the problem and put more and more people in harm’s way. Which is a crime in itself.

 

The sayings of Hafiz Saeed, who founded the Lashkar-e-Taiba (Army of the Pure) in 1990 and who belongs to the hardline Salafi tradition of Islam, certainly bolsters the case of Side A. Hafiz Saeed approves of suicide bombing, hates Jews, Shias and Democracy and believes that jihad should be waged until Islam, his Islam, rules the world. Among the things he said are: "There cannot be any peace while India remains intact. Cut them, cut them so much that they kneel before you and ask for mercy."

 

And: "India has shown us this path. We would like to give India a tit-for-tat response and reciprocate in the same way by killing the Hindus, just like it is killing the Muslims in Kashmir."

 

But where would Side A accommodate the sayings of Babu Bajrangi of Ahmedabad, India, who sees himself as a democrat, not a terrorist? He was one of the major lynchpins of the 2002 Gujarat genocide and has said (on camera): "We didn’t spare a single Muslim shop, we set everything on fire … we hacked, burned, set on fire … we believe in setting them on fire because these bastards don’t want to be cremated, they’re afraid of it … I have just one last wish … let me be sentenced to death … I don’t care if I’m hanged … just give me two days before my hanging and I will go and have a field day in Juhapura where seven or eight lakhs [seven or eight hundred thousand] of these people stay … I will finish them off … let a few more of them die … at least 25,000 to 50,000 should die."

 

And where, in Side A’s scheme of things, would we place the Rashtriya Swayamsevak Sangh bible, We, or, Our Nationhood Defined by MS Golwalkar, who became head of the RSS in 1944. It says: "Ever since that evil day, when Moslems first landed in Hindustan, right up to the present moment, the Hindu Nation has been gallantly fighting on to take on these despoilers. The Race Spirit has been awakening."

 

Or: "To keep up the purity of its race and culture, Germany shocked the world by her purging the country of the Semitic races – the Jews. Race pride at its highest has been manifested here … a good lesson for us in Hindustan to learn and profit by."

 

(Of course Muslims are not the only people in the gun sights of the Hindu right. Dalits have been consistently targeted. Recently in Kandhamal in Orissa, Christians were the target of two and a half months of violence which left more than 40 dead. Forty thousand people have been driven from their homes, half of who now live in refugee camps.)

 

All these years Hafiz Saeed has lived the life of a respectable man in Lahore as the head of the Jamaat-ud Daawa, which many believe is a front organization for the Lashkar-e-Taiba. He continues to recruit young boys for his own bigoted jehad with his twisted, fiery sermons. On December 11 the UN imposed sanctions on the Jammat-ud-Daawa. The Pakistani government succumbed to international pressure and put Hafiz Saeed under house arrest. Babu Bajrangi, however, is out on bail and lives the life of a respectable man in Gujarat. A couple of years after the genocide he left the VHP to join the Shiv Sena. Narendra Modi, Bajrangi’s former mentor, is still the chief minister of Gujarat. So the man who presided over the Gujarat genocide was re-elected twice, and is deeply respected by India’s biggest corporate houses, Reliance and Tata.

 

Suhel Seth, a TV impresario and corporate spokesperson, recently said: "Modi is God." The policemen who supervised and sometimes even assisted the rampaging Hindu mobs in Gujarat have been rewarded and promoted. The RSS has 45,000 branches, its own range of charities and 7 million volunteers preaching its doctrine of hate across India. They include Narendra Modi, but also former prime minister AB Vajpayee, current leader of the opposition LK Advani, and a host of other senior politicians, bureaucrats and police and intelligence officers.

 

If that’s not enough to complicate our picture of secular democracy, we should place on record that there are plenty of Muslim organisations within India preaching their own narrow bigotry.

 

So, on balance, if I had to choose between Side A and Side B, I’d pick Side B. We need context. Always.

 

In this nuclear subcontinent that context is partition. The Radcliffe Line, which separated India and Pakistan and tore through states, districts, villages, fields, communities, water systems, homes and families, was drawn virtually overnight. It was Britain’s final, parting kick to us. Partition triggered the massacre of more than a million people and the largest migration of a human population in contemporary history. Eight million people, Hindus fleeing the new Pakistan, Muslims fleeing the new kind of India left their homes with nothing but the clothes on their backs.

 

Each of those people carries and passes down a story of unimaginable pain, hate, horror but yearning too. That wound, those torn but still unsevered muscles, that blood and those splintered bones still lock us together in a close embrace of hatred, terrifying familiarity but also love. It has left Kashmir trapped in a nightmare from which it can’t seem to emerge, a nightmare that has claimed more than 60,000 lives. Pakistan, the Land of the Pure, became an Islamic Republic, and then, very quickly a corrupt, violent military state, openly intolerant of other faiths. India on the other hand declared herself an inclusive, secular democracy. It was a magnificent undertaking, but Babu Bajrangi’s predecessors had been hard at work since the 1920s, dripping poison into India’s bloodstream, undermining that idea of India even before it was born.

 

By 1990 they were ready to make a bid for power. In 1992 Hindu mobs exhorted by LK Advani stormed the Babri Masjid and demolished it. By 1998 the BJP was in power at the centre. The US war on terror put the wind in their sails. It allowed them to do exactly as they pleased, even to commit genocide and then present their fascism as a legitimate form of chaotic democracy. This happened at a time when India had opened its huge market to international finance and it was in the interests of international corporations and the media houses they owned to project it as a country that could do no wrong. That gave Hindu nationalists all the impetus and the impunity they needed.

 

This, then, is the larger historical context of terrorism in the subcontinent and of the Mumbai attacks. It shouldn’t surprise us that Hafiz Saeed of the Lashkar-e-Taiba is from Shimla (India) and LK Advani of the Rashtriya Swayam Sevak Sangh is from Sindh (Pakistan).

 

In much the same way as it did after the 2001 parliament attack, the 2002 burning of the Sabarmati Express and the 2007 bombing of the Samjhauta Express, the government of India announced that it has "incontrovertible" evidence that the Lashkar-e-Taiba backed by Pakistan’s ISI was behind the Mumbai strikes. The Lashkar has denied involvement, but remains the prime accused. According to the police and intelligence agencies the Lashkar operates in India through an organisation called the Indian Mujahideen. Two Indian nationals, Sheikh Mukhtar Ahmed, a Special Police Officer working for the Jammu and Kashmir police, and Tausif Rehman, a resident of Kolkata in West Bengal, have been arrested in connection with the Mumbai attacks.

 

So already the neat accusation against Pakistan is getting a little messy. Almost always, when these stories unspool, they reveal a complicated global network of foot soldiers, trainers, recruiters, middlemen and undercover intelligence and counter-intelligenc e operatives working not just on both sides of the India-Pakistan border, but in several countries simultaneously. In today’s world, trying to pin down the provenance of a terrorist strike and isolate it within the borders of a single nation state is very much like trying to pin down the provenance of corporate money. It’s almost impossible.

 

In circumstances like these, air strikes to "take out" terrorist camps may take out the camps, but certainly will not "take out" the terrorists. Neither will war. (Also, in our bid for the moral high ground, let’s try not to forget that the Liberation Tigers of Tamil Eelam, the LTTE of neighbouring Sri Lanka, one of the world’s most deadly terrorist groups, were trained by the Indian army.)

 

Thanks largely to the part it was forced to play as America’s ally first in its war in support of the Afghan Islamists and then in its war against them, Pakistan, whose territory is reeling under these contradictions, is careening towards civil war. As recruiting agents for America’s jihad against the Soviet Union, it was the job of the Pakistan army and the ISI to nurture and channel funds to Islamic fundamentalist organizations. Having wired up these Frankensteins and released them into the world, the US expected it could rein them in like pet mastiffs whenever it wanted to.

 

Certainly it did not expect them to come calling in heart of the Homeland on September 11. So once again, Afghanistan had to be violently remade. Now the debris of a re-ravaged Afghanistan has washed up on Pakistan’s borders. Nobody, least of all the Pakistan government, denies that it is presiding over a country that is threatening to implode. The terrorist training camps, the fire-breathing mullahs and the maniacs who believe that Islam will, or should, rule the world is mostly the detritus of two Afghan wars. Their ire rains down on the Pakistan government and Pakistani civilians as much, if not more than it does on India.

 

If at this point India decides to go to war perhaps the descent of the whole region into chaos will be complete. The debris of a bankrupt, destroyed Pakistan will wash up on India’s shores, endangering us as never before. If Pakistan collapses, we can look forward to having millions of "non-state actors" with an arsenal of nuclear weapons at their disposal as neighbours. It’s hard to understand why those who steer India’s ship are so keen to replicate Pakistan’s mistakes and call damnation upon this country by inviting the United States to further meddle clumsily and dangerously in our extremely complicated affairs. A superpower never has allies. It only has agents.

 

On the plus side, the advantage of going to war is that it’s the best way for India to avoid facing up to the serious trouble building on our home front. The Mumbai attacks were broadcast live (and exclusive!) on all or most of our 67 24-hour news channels and god knows how many international ones. TV anchors in their studios and journalists at "ground zero" kept up an endless stream of excited commentary. Over three days and three nights we watched in disbelief as a small group of very young men armed with guns and gadgets exposed the powerlessness of the police, the elite National Security Guard and the marine commandos of this supposedly mighty, nuclear-powered nation.

 

While they did this they indiscriminately massacred unarmed people, in railway stations, hospitals and luxury hotels, unmindful of their class, caste, religion or nationality. (Part of the helplessness of the security forces had to do with having to worry about hostages. In other situations, in Kashmir for example, their tactics are not so sensitive. Whole buildings are blown up. Human shields are used. The U.S and Israeli armies don’t hesitate to send cruise missiles into buildings and drop daisy cutters on wedding parties in Palestine, Iraq and Afghanistan. ) But this was different. And it was on TV.

 

The boy-terrorists’ nonchalant willingness to kill – and be killed – mesmerised their international audience. They delivered something different from the usual diet of suicide bombings and missile attacks that people have grown inured to on the news. Here was something new. Die Hard 25. The gruesome performance went on and on. TV ratings soared. Ask any television magnate or corporate advertiser who measures broadcast time in seconds, not minutes, what that’s worth.

 

Eventually the killers died and died hard, all but one. (Perhaps, in the chaos, some escaped. We may never know.) Throughout the standoff the terrorists made no demands and expressed no desire to negotiate. Their purpose was to kill people and inflict as much damage as they could before they were killed themselves. They left us completely bewildered. When we say "nothing can justify terrorism", what most of us mean is that nothing can justify the taking of human life. We say this because we respect life, because we think it’s precious. So what are we to make of those who care nothing for life, not even their own? The truth is that we have no idea what to make of them, because we can sense that even before they’ve died, they’ve journeyed to another world where we cannot reach them.

 

One TV channel (India TV) broadcast a phone conversation with one of the attackers, who called himself Imran Babar. I cannot vouch for the veracity of the conversation, but the things he talked about were the things contained in the "terror emails" that were sent out before several other bomb attacks in India. Things we don’t want to talk about any more: the demolition of the Babri Masjid in 1992, the genocidal slaughter of Muslims in Gujarat in 2002, the brutal repression in Kashmir. "You’re surrounded," the anchor told him. "You are definitely going to die. Why don’t you surrender?"

 

"We die every day," he replied in a strange, mechanical way. "It’s better to live one day as a lion and then die this way." He didn’t seem to want to change the world. He just seemed to want to take it down with him.

 

If the men were indeed members of the Lashkar-e-Taiba, why didn’t it matter to them that a large number of their victims were Muslim, or that their action was likely to result in a severe backlash against the Muslim community in India whose rights they claim to be fighting for? Terrorism is a heartless ideology, and like most ideologies that have their eye on the Big Picture, individuals don’t figure in their calculations except as collateral damage. It has always been a part of and often even the aim of terrorist strategy to exacerbate a bad situation in order to expose hidden faultlines. The blood of "martyrs" irrigates terrorism. Hindu terrorists need dead Hindus, Communist terrorists need dead proletarians, Islamist terrorists need dead Muslims. The dead become the demonstration, the proof of victimhood, which is central to the project. A single act of terrorism is not in itself meant to achieve military victory; at best it is meant to be a catalyst that triggers something else, something much larger than itself, a tectonic shift, a realignment. The act itself is theatre, spectacle and symbolism, and today, the stage on which it pirouettes and performs its acts of bestiality is Live TV. Even as the attack was being condemned by TV anchors, the effectiveness of the terror strikes were being magnified a thousandfold by TV broadcasts.

 

Through the endless hours of analysis and the endless op-ed essays, in India at least there has been very little mention of the elephants in the room: Kashmir, Gujarat and the demolition of the Babri Masjid. Instead we had retired diplomats and strategic experts debate the pros and cons of a war against Pakistan. We had the rich threatening not to pay their taxes unless their security was guaranteed (is it alright for the poor to remain unprotected? ). We had people suggest that the government step down and each state in India be handed over to a separate corporation. We had the death of former prime minster VP Singh, the hero of Dalits and lower castes and villain of Upper caste Hindus pass without a mention.

 

We had Suketu Mehta, author of Maximum City and co-writer of the Bollywood film Mission Kashmir, give us his version of George Bush’s famous "Why they hate us" speech. His analysis of why religious bigots, both Hindu and Muslim hate Mumbai: "Perhaps because Mumbai stands for lucre, profane dreams and an indiscriminate openness." His prescription: "The best answer to the terrorists is to dream bigger, make even more money, and visit Mumbai more than ever." Didn’t George Bush ask Americans to go out and shop after 9/11? Ah yes. 9/11, the day we can’t seem to get away from.

 

Though one chapter of horror in Mumbai has ended, another might have just begun. Day after day, a powerful, vociferous section of the Indian elite, goaded by marauding TV anchors who make Fox News look almost radical and leftwing, have taken to mindlessly attacking politicians, all politicians, glorifying the police and the army and virtually asking for a police state. It isn’t surprising that those who have grown plump on the pickings of democracy (such as it is) should now be calling for a police state. The era of "pickings" is long gone. We’re now in the era of Grabbing by Force, and democracy has a terrible habit of getting in the way.

 

Dangerous, stupid television flashcards like the Police are Good Politicians are Bad/Chief Executives are Good Chief Ministers are Bad/Army is Good Government is Bad/ India is Good Pakistan is Bad are being bandied about by TV channels that have already whipped their viewers into a state of almost uncontrollable hysteria.

 

Tragically, this regression into intellectual infancy comes at a time when people in India were beginning to see that in the business of terrorism, victims and perpetrators sometimes exchange roles. It’s an understanding that the people of Kashmir, given their dreadful experiences of the last 20 years, have honed to an exquisite art. On the mainland we’re still learning. (If Kashmir won’t willingly integrate into India, it’s beginning to look as though India will integrate/disintegr ate into Kashmir.)

 

It was after the 2001 parliament attack that the first serious questions began to be raised. A campaign by a group of lawyers and activists exposed how innocent people had been framed by the police and the press, how evidence was fabricated, how witnesses lied, how due process had been criminally violated at every stage of the investigation. Eventually the courts acquitted two out of the four accused, including SAR Geelani, the man whom the police claimed was the mastermind of the operation. A third, Showkat Guru, was acquitted of all the charges brought against him but was then convicted for a fresh, comparatively minor offence. The supreme court upheld the death sentence of another of the accused, Mohammad Afzal. In its judgment the court acknowledged there was no proof that Mohammed Afzal belonged to any terrorist group, but went on to say, quite shockingly, "The collective conscience of the society will only be satisfied if capital punishment is awarded to the offender." Even today we don’t really know who the terrorists that attacked the Indian parliament were and who they worked for.

 

More recently, on September 19 this year, we had the controversial "encounter" at Batla House in Jamia Nagar, Delhi, where the Special Cell of the Delhi police gunned down two Muslim students in their rented flat under seriously questionable circumstances, claiming that they were responsible for serial bombings in Delhi, Jaipur and Ahmedabad in 2008. An assistant commissioner of Police, Mohan Chand Sharma, who played a key role in the parliament attack investigation, lost his life as well. He was one of India’s many "encounter specialists" known and rewarded for having summarily executed several "terrorists" . There was an outcry against the Special Cell from a spectrum of people, ranging from eyewitnesses in the local community to senior Congress Party leaders, students, journalists, lawyers, academics and activists all of whom demanded a judicial inquiry into the incident. In response, the BJP and LK Advani lauded Mohan Chand Sharma as a "Braveheart" and launched a concerted campaign in which they targeted those who had dared to question the integrity of the police, saying it was "suicidal" and calling them "anti-national" . Of course there has been no inquiry.

 

Only days after the Batla House event, another story about "terrorists" surfaced in the news. In a report submitted to a sessions court, the CBI said that a team from Delhi’s Special Cell (the same team that led the Batla House encounter, including Mohan Chand Sharma) had abducted two innocent men, Irshad Ali and Moarif Qamar, in December 2005, planted 2kg of RDX and two pistols on them and then arrested them as "terrorists" who belonged to Al Badr (which operates out of Kashmir). Ali and Qamar who have spent years in jail, are only two examples out of hundreds of Muslims who have been similarly jailed, tortured and even killed on false charges.

 

This pattern changed in October 2008 when Maharashtra’ s Anti-Terrorism Squad (ATS) that was investigating the September 2008 Malegaon blasts arrested a Hindu preacher Sadhvi Pragya, a self-styled God man Swami Dayanand Pande and Lt Col Purohit, a serving officer of the Indian Army. All the arrested belong to Hindu Nationalist organizations including a Hindu Supremacist group called Abhinav Bharat. The Shiv Sena, the BJP and the RSS condemned the Maharashtra ATS, and vilified its chief, Hemant Karkare, claiming he was part of a political conspiracy and declaring that "Hindus could not be terrorists". LK Advani changed his mind about his policy on the police and made rabble rousing speeches to huge gatherings in which he denounced the ATS for daring to cast aspersions on holy men and women.

 

On the November 25 newspapers reported that the ATS was investigating the high profile VHP Chief Pravin Togadia’s possible role in the Malegaon blasts. The next day, in an extraordinary twist of fate, Hemant Karkare was killed in the Mumbai Attacks. The chances are that the new chief whoever he is, will find it hard to withstand the political pressure that is bound to be brought on him over the Malegaon investigation.

 

While the Sangh Parivar does not seem to have come to a final decision over whether or not it is anti-national and suicidal to question the police, Arnab Goswami, anchorperson of Times Now television, has stepped up to the plate. He has taken to naming, demonising and openly heckling people who have dared to question the integrity of the police and armed forces. My name and the name of the well-known lawyer Prashant Bhushan have come up several times. At one point, while interviewing a former police officer, Arnab Goswami turned to camera: "Arundhati Roy and Prashant Bhushan," he said, "I hope you are watching this. We think you are disgusting." For a TV anchor to do this in an atmosphere as charged and as frenzied as the one that prevails today, amounts to incitement as well as threat, and would probably in different circumstances have cost a journalist his or her job.

 

So according to a man aspiring to be the next prime minister of India, and another who is the public face of a mainstream TV channel, citizens have no right to raise questions about the police. This in a country with a shadowy history of suspicious terror attacks, murky investigations, and fake "encounters" . This in a country that boasts of the highest number of custodial deaths in the world and yet refuses to ratify the International Covenant on Torture. A country where the ones who make it to torture chambers are the lucky ones because at least they’ve escaped being "encountered" by our Encounter Specialists. A country where the line between the Underworld and the Encounter Specialists virtually does not exist.

 

How should those of us whose hearts have been sickened by the knowledge of all of this view the Mumbai attacks, and what are we to do about them? There are those who point out that US strategy has been successful inasmuch as the United States has not suffered a major attack on its home ground since 9/11. However, some would say that what America is suffering now is far worse. If the idea behind the 9/11 terror attacks was to goad America into showing its true colors, what greater success could the terrorists have asked for? The US army is bogged down in two unwinnable wars, which have made the United States the most hated country in the world. Those wars have contributed greatly to the unraveling of the American economy and who knows, perhaps eventually the American empire. (Could it be that battered, bombed Afghanistan, the graveyard of the Soviet Union, will be the undoing of this one too?) Hundreds of thousands people including thousands of American soldiers have lost their lives in Iraq and Afghanistan. The frequency of terrorist strikes on U.S allies/agents (including India) and U.S interests in the rest of the world has increased dramatically since 9/11. George Bush, the man who led the US response to 9/11 is a despised figure not just internationally, but also by his own people. Who can possibly claim that the United States is winning the war on terror?

 

Homeland Security has cost the US government billions of dollars. Few countries, certainly not India, can afford that sort of price tag. But even if we could, the fact is that this vast homeland of ours cannot be secured or policed in the way the United States has been. It’s not that kind of homeland. We have a hostile nuclear weapons state that is slowly spinning out of control as a neighbour, we have a military occupation in Kashmir and a shamefully persecuted, impoverished minority of more than 150 million Muslims who are being targeted as a community and pushed to the wall, whose young see no justice on the horizon, and who, were they to totally lose hope and radicalise, end up as a threat not just to India, but to the whole world. If ten men can hold off the NSG commandos, and the police for three days, and if it takes half a million soldiers to hold down the Kashmir valley, do the math. What kind of Homeland Security can secure India?

 

Nor for that matter will any other quick fix. Anti-terrorism laws are not meant for terrorists; they’re for people that governments don’t like. That’s why they have a conviction rate of less than 2%. They’re just a means of putting inconvenient people away without bail for a long time and eventually letting them go. Terrorists like those who attacked Mumbai are hardly likely to be deterred by the prospect of being refused bail or being sentenced to death. It’s what they want.

 

What we’re experiencing now is blowback, the cumulative result of decades of quick fixes and dirty deeds. The carpet’s squelching under our feet.

 

The only way to contain (it would be naïve to say end) terrorism is to look at the monster in the mirror. We’re standing at a fork in the road. One sign says Justice, the other Civil War. There’s no third sign and there’s no going back. Choose.

The penal court in Cairo witnessed a last minute rebound in the bribery and corruption case related to the Damietta Container Company, in which the third, fifth and sixth accused have recognized having committed corruption offences for which they have been charged. The main accused Ali Ahmad Saad, Chairman of the board of directors and official representative of the company, has denied any involvement in the matter.

The court presided by judge Ahmad Refaat, aided by judges Yahia Ramadan and Mohammad Assem, in the presence of Mr.Wadih Hanna Nached, president of the Public Funds Committee, and Mr.Imad Afifi, as secretary, decided to postpone the debates to November 9th 2006 in order to hear the testimony of the civil party.

The main accused, Ali Massaad, as well as the witnesses and the employees have been interrogated by the court.

The court decided the admissibility of Mistral holding’s petition (CMA’s shareholder) for temporary compensation in the amount of 5001 Egyptian pounds, for the prejudice incurred as a result of this corruption case. The court also rejected CMA’s request to reject Mistral holding’s petition.

The Public Funds Committee had previously handed over to justice the following accused: Ali Massaad Ahmad, the company’s chairman of the board of directors and legal representative of the Damietta Container Company, Maher Ahmad Almass, accountant within the same company, fugitive, Jihad Anis Dagher, employee within the Leader Group company, Nabil Elie Bassil, financial manager and administrator of the said company, fugitive, Mustapha Mohammad Khalil Abd An-Naim, manager of the Damietta subsidiary of Leader Group, as well as Jamal Abd Ar-Razzak Abd As-Sadek and Mahmoud Ahmad Yacoub; respectively to the An-Nouzha and Damietta police stations, for their proceedings between 1997 and March 2006 in asking for and collecting bribes for a value of USD 30,000 and for infringement to their duties and professional obligations.

In Search of War-free World

Man may or may not accept the questions of ultimate causes and purposes, of reality of man and other living beings, and of  matter, energy and consciousness, as insoluble mystery or may or may not find himself unable to reach some supreme Reality or may or may not believe in God as enforcing His moral discipline, but his targets of life should not be such as determined  on uncertain antagonistic basis and attainable by shedding blood of each other, but should be addressed  to social cohesion and peace. Without peace viz. in conditions of tension and wars, material acquisitions do not give enjoyment, but bring worries.  

 

       Man, by his original error, has been taking the world for his own indulgence resulting in individuals’ inter se relationship as of rivalry and violence, spending whole life so far in becoming strong by accumulating wealth and inventing weapons of war and shedding blood of his own kind. The present order has, therefore, developed as pro-establishment and anti people. As the path is leading mankind to catastrophic conditions, man should seek some other way that may save mankind from the apprehended dark future. Capitalism and socialism are not the only systems, either to replace the other. Both are based on the same error of self indulgence, growing from hostile atomism leaving no scope for an order of co-existence. 

 

    Man has produced neither the world nor himself that he may fix his targets of life as self indulgence and self supremacy. The world produces beings/individuals from its own self with certain potentials and properties for its own purpose. It has provided every being with the reproductive system and divided each species into male and female genders obviously for its own continuity through their offspring. Beings have been provided with other faculties and properties for their maintenance Thus the role of individuals is of contribution to the world order like all other forces of nature. In performing their role in the service of the world order, beings get superior enjoyment to that pleasure that they get in sensual indulgence and arrogance. All beings are therefore for one purpose that is to serve the world order and therefore their inter se relationships become that of cooperation, co-existence and love, not of rivalry, tension  and wars. Mankind should therefore develop a culture that should   establish a world order of coexistence finishing all chances of wars and that is possible in realizing the reality as cohesive organism

 

        Materialism that has been erected by the commercial class on hostile atomism, not on science, is illogical and is obsessed with the motivation of increasing their own wealth, not for the wellbeing of the people. It is also in struggle to get emancipation from the papacy that imposes moral discipline which businessmen think as anti progress. . Though material science has given mankind many things of comforts, speed and efficiency, but, materialism that rules the people by its political science and economics, which are not authenticated as scientific by the scientists, .is responsible for all the modern human problems which are threatening the very existence of mankind. The problems emanate from its wrong targets of self indulgence and self supremacy, and doctrines like individualism, competition, and the misuse of maxim of survival of the fittest with the corollary that unfit must suffer for their  unfitness. These are against the spirit of social cohesion and peace and deny others right to live with dignity.

 

     Modernism since its advent has ever been pursing linear approach in inventing   things and innovating measures, claiming to make life comfortable, but practically for eliminating each other, making life complicated, hard, stressful and devastating by result. People are allured by it as well as fearful of its march and find themselves disillusioned and helpless apprehending that this way goes to hell, not to paradise Theoretically, they are to cooperate, compete and co-exist in the exploitation of Nature for this purpose. But people competing for self indulgence and self supremacy, cannot by nature co-exist. They exploit Nature in competition for eliminating each other.      

 

    Atomism developed after industry was mechanized in Europe. Then their businessmen became greedy and arrogant and made their targets as self indulgence and self supremacy, holding that progress is possible by competition. The European countries became the producers and the whole world was their market, thereby they became prosperous.. In the process they themselves fought many bloody wars for carving out their empires and   wasted their funds on wars. After the World War II, the slave countries become free and they too have become industrialized and producers. Mechanization of industry is increasing unemployment and   bringing poverty to the majority of the people.   Now the whole world is going to be producer producing goods much more than the need and beyond the purchasing power of the majority. The mechanized capitalism is waiting for its own collapse and the end of atomism though it has already got  crippled by its own produced problems viz. pollution, global warming, over-consumption of natural resources,  diseases and other problems routed in them. Though   disillusioned from this order, atomists   feel helpless seeing no other alternative.

 

   Now the people are at the mercy of lethal weapons, terrorism; wars, stress and tension, global warming and pollution of environments and food, diseases like cancer as legacy of this order. These problems are the product of .atomism and the state constitutions made under it. Issues of purposefulness of life, stability of family, social cohesion and peace of mind most needed by mankind, pose greatest challenge to the linear atomism .From the above results we do understand that the path is wrong and needs revolutionary change, not patch work in the present system. Presently  countries are governed by state hostile polities under nationalism and patriotism. Its antidote is world polity World polity means one system to govern the whole mankind believing in oneness of mankind and for the welfare of all. World government is different thing from world polity. The former can be by domination of one country without believing in the oneness of mankind and the welfare of all.  Feasibility of world polity has to be maintained as there is no other alterative. As state polities are under atomism, World Polity would be established in the culture of its antidote organism.

 

. The world in reality is an organism functioning by its own produced constituents by their inter se relationship of complementarity and interdependence. We understand that all beings have the one and the same source, support and destination. These facts point to the oneness of mankind as the reality and to the divinity of   world polity. Purpose of life is enjoyment by making contribution. Tendencies of assertion and greed are individual’s weaknesses, not reality. It is to be won over and can be won over by culture of organism.

 

        People should raise voice against exploitative atomism and for the annulment of the constitution made there under and a new one be made on the basis of organism, not by politicians but by those who believe in the oneness of mankind and co-existence to function as per world polity; allowing freedom for local cultures and arrangements, subject to their conformity to the world polity. It appeals to the governments and universities to reject state polities and instead propose world polity to be enforced though UN. It would save mankind from destruction by wars and wastage of huge funds on arrangement of armies, parliaments and legislative assemblies and law and order machinery. Laws would be part of culture and education. Education of organism in all units/countries would be under UN to ensure that no unit gets   inclined for assertion over others.           

 

        Organism is the seed of phenomena, from which two leaves or wings sprout, one of World Polity and the other is of Culture, which are complementary like male and female genders for the maintenance of the world order. Culture disciplines the world polity and world polity protects culture.        The forum of UN can play the role for promulgating world polity from above. As an agency of the whole world, world polity under UN would check competition and exploitation between countries from top. Within the states, after being free from fear of external aggression, the culture of organism   would guide and discipline minds of the people both in authority and in the public at the bottom, to work for the welfare of all, not for self supremacy. The states then would be administrative units.   UN would prepare the member countries to adopt organism as path of peace and cooperation and shun the path of exploitation of each other by trade or militarily in the interest of world peace It would amend its own Charter of objectives by the new one and ask member countries to change their own constitutions too with the objective of ending economic exploitation of the people and the countries by trade or militarily,
